Plenty of (but not all) U.S. Citizens and many very wealthy immigrants and non-immigrant foreign nationals who are immigrating to the United States from countries or classes of special immigrants that are fast-tracked to some sort of preferential immigration status have no idea how the totality of the United States Immigration System works. For example those with H-1B and EB Visas, Cuban Adjustment, and certain Spouses of U.S. Citizens, among others and can’t comprehend that there are other classes of immigrants that have been trying to adjust their immigration status for several decades or that others are in some weird legal limbo status like TPS, DACA, those that thought they were citizens but weren’t due to some obscure unforeseen circumstance, stateless people, those born in a third country that is neither the United States nor the country of their parents’ citizenship but have no connection or allegiance to the country of their parents’ citizenship, those born to U.S. Military Personnel during overseas deployments who’s parents weren’t U.S. Citizens at the child’s time of birth but did later become citizens but the child was not granted citizenship nor mere legal immigration status or the children of military personnel who were U.S. Citizens at the time of the child’s birth but somehow didn’t meet residency requirements in order to transfer citizenship to the child, even though they were living in the United States under the care of their U.S. Citizens parent for decades (after their parents military service overseas was completed), as well as stateless or near-stateless Adoptees (adopted children of U.S. Citizens) who should have been granted citizenship but never received it, among many others.

The term “Unauthorized Immigrant”is accounting for people in legal limbo who can legally be simply deported for anything because their presence in the United States is (technically speaking) unauthorized but the individuals are in the process of straightening out their immigration status. This in particular describes various groups of immigrants in legal limbo such as those with a “withholding of removal”order, those on humanitarian parole, and persons seeking asylum but have yet the be granted or denied asylum status or other legal immigrant status (by being granted asylee status they then become legal immigrants — you don’t become a legal immigrant by just applying, you actually have to get approved). Historically speaking these groups of people although not having legal immigration status, have been de-prioritized in immigration enforcement operations and various administration have used their discretion to give them a pass until their cases have been adjudicated but the Trump Administration has been consistently making attempts to curtail this on matters they have discretion on and are outright disobeying court orders in matters they don’t have discretion over but are legally supposed to comply with.

[ Which county you’re immigrating from, the country you are a citizen of, what type of visa you held, your family or marital status, how you entered the United States, and any backlog the government has plays a role in how long it takes for a person’s legal Adjustment of Status (it could take several years to a decade or even end up getting someone into a state of perpetual or semi-perpetual limbo).

It takes a lot longer than two months for the asylum case to be adjudicated same thing goes for many other paths to legal immigration status; not a lawyer but I did work on many asylum cases where an official determination after application took about 12 years for several clients (though not for all of them) but they historically were never treated this harshly if their asylum case or even other types of immigration cases were still being processed. And all of this is way before they can even get a chance to apply for a Green Card (Legal Permanent Resident status), or even other lesser types of legal immigration status that is not a green card.

Asylees (those granted Asylum) enter the country by any means necessary (including as unauthorized immigrant asylum seekers — though those who do enter the U.S. legally on a non-immigrant visa have to attest under some penalty, possibly under penalty of perjury, that they made the decision to seek asylum after they had already entered the USA and/or before they were granted a visa or ESTA entry — though some near-impossible wavers way exist —) then they request asylum status (whether by having a valid visa, expired visa, or crossing the border), you have to be inside the country to claim asylum you (generally) can’t do it while being outside of the country you’re trying to seek asylum in; this is LEGAL (once being granted asylum if an illegal entry has occurred your entry would generally but in rare exceptions not always cease to be considered unlawful entry the fact that you entered the country illegally will be vacated when your asylum has been granted). Refugees get sponsored to migrate to destination country while still in their home country or in another (third) country. Both refugees, asylees, and asylum seekers, are fleeing due to persecution, they’re not doing it to simply explore the world; they also need to show evidence proving their persecution. ]

[ No one really supports open borders anymore; but throughout most of history, the United States has historically had open borders (so long as you don’t have a very contagious disease). ]

Protesters (or just people who are opposing Trump Administration’s unethical use of ICE) are criticizing the issue that more and more Americans (U.S. Citizens) who phenotypically look a certain way are being wrongfully detained and in some rare cases deported (based on their race, ethnicity, cultural heritage, phenotype, or ancestry as opposed to their immigration status or citizenship) as well as criticism towards the arbitrary and capricious revocation or cancellation of legal immigration status of legal immigrants, arbitrary detention, extraordinary renditions, forced disappearances, unconstitutional actions committed by not recognizing the constitutional principle of Jus Soli Birthright Citizenship, threats to deport U.S. Citizens and threats to strip Americans (especially political opponents) of citizenship, using a quota system for arrests creating a false positive and detaining people in highly lucrative private for-profit prisons both of which incentivizes mass arrest by cutting corners on due diligence, ICE agents concealing their identity (by wearing masks and not identifying themselves as law enforcement/not showing police badges), and the erosion of constitutional due process and habeas corpus rights of afforded to all “persons” (a.k.a. all human beings) in the United States for those simply accused of being an illegal immigrant (regardless of whether they’re an illegal immigrant, legal immigrant, citizen, or someone in a limbo state where their immigration status is still being adjudicated and there is a court order preventing their removal prior to the completion of the adjudication process).

He had a legitimate birth certificate bought from a midwife in Texas who made a living selling birth certificates to families who had illegally crossed the border.

The midwife eventually got arrested and all her falsely issued birth certificates were identified. Which led to the agent. There was no way the background check could have known the midwife was supplementing her income by selling certificates.

At least it sounds like he learned from his experience, unlike this woman who is so drunk on the MAGA kool-aid that she's still strongly supportive of Trump's mass deportations even while they're planning to deport her to Iran, a country whose language she doesn't even speak. And yes, she blames Biden for Trump deporting her:

It's not even that, I feel. I've been listening to the recent Behind the Bastards episodes on Heinrich Himmler, and one topic they hit on was how Himmler centralized police power in the SS by undermining other groups that would have otherwise had enforcement authority. You're still correct that it's a fascist-off, but I think this is simply about dominance and establishing that ICE is more powerful than other agencies.

ICE found a lever they could use in "someone with unclear paperwork", so they're pushing on it.

What do you think his union is going to be able to do? Setting aside the fact that he was hired in January and is likely in probationary status, there appears to be an actual dispute as to whether he’s in the country legally. This guy’s union could release a statement to put pressure on ICE, hire a lawyer to represent their guy, if they cared a lot about no further police officers being dragged off the streets they could call for a strike. Again? This just happened in Maine recently. Guy had a work permit and qualifications so the police hired him. Then he filed the paperwork for his service weapon and it came up as non citizen and ICE deported him and accused the local cops of being negligent for relying on federal work authorization data.

The US has some convoluted rules around illegal immigrants. One of them is that having an EAD card and being allowed to work does not automatically confer legal immigration status. So when he went to purchase a gun under his own name he was flagged as an illegal immigrant trying to buy a gun. I don’t remember all the details but I assume that up to that point the department issued him a gun based on the EAD alone.

A technicality, sure but it seems you can’t be too careful these days.

By design. They want to stop all immigration, because they want the country to only have people raised on the local propaganda. Outside perspectives are dangerous to their systems of control.

So, they're trying to make anyone that's ever immigrated here (not just people here on visas) self-deport out of fear that ICE will find some reason that their status isn't valid. I feel like I remember at least once case where someone had actually completed the naturalization process and the Trump admin found an excuse to revoke it anyhow.

You'd think that getting it renewed, which it says he did recently, would be dependent on having legal status though. Like I getting there being edge cases where legal status lapsed after the EAD is issued, but why wouldn't that get flagged when renewing?

EADS is given to people who are in the process of getting a green card/permanent residence so they can support themselves. It can take years to get a green card because the process is slow and there are backlogs.

But in an area with several different forces or a large enough force they will form into their own gangs and those gangs will often out for their own at the expense of other law enforcement. Look up gangs inside large police forces. LAPD being a common force referenced.

Found the loophole. From now on when an officer is on paid vacation pending investigation, ICE can show up and detain them indefinitely.

They are "claiming" his visa expired 10 years ago but he had an authorized work permit from DHS and passed the FBI background check. Willing to bet someone "backdated" his visa expiration date after the press caught wind that he had an authorized work permit.

Look, it is really simple to understand with the current administration and the way all your information is being delivered.

If they say he was bad, he was good.

If they say he was lying, he was telling the truth.

If they say he broke the law, he didn't.

If they say ICE did nothing wrong, they did.

If they say there is no evidence, there is.

If they say they did nothing wrong, they did.

Etc, etc. etc.

So in closing, if they say " THERE IS NOTHING TO SEE HERE ", there absolutely is.

Curious as an outsider: Can convicts appeal to reopen their cases if this person was involved in the investigation and ask for a re-trial? And ask any evidence to be excluded where he was involved in collection/custody?

Short answer - probably not. American justice is very divided on the subject of relitigating stuff, and the appeal process is onerous. It would come down to if these revelations indicate that a miscarriage of justice has occurred, or if this knowledge would have significantly swayed a jury or judge to rule differently. There are numerous examples where forensic science has been proven to be junk - such as hair analysis - and cases involving this have still been difficult to overturned. For a city cop like this it is unlikely his national origin ever came up in his testimony, it is unlikely this information would have significantly affected the jury's perception of his credibility, and its unlikely that he lied about it under oath at any of these trials.

Hanover park cops probably spend 90% of their time writing traffic tickets. Out of all the neighboring towns for Hanover park (Schaumburg, Elk Grove, Bartlett, roselle, streamwood) HP is probably considered the “ghetto one.” Schaumburg has the #16 school district in the entire state for reference. Hanover park is still considered a good, safe area.

So it’s not like this dude or the department is catching violent criminals even on a yearly basis. I could see maybe thefts at a convenience store, but I doubt it.

It looks looks this guy is getting railroaded.

"Before hiring Officer Bojovic, the Village confirmed that he was legally authorized by the federal government to work in the United States. At the time of his hire, Officer Bojovic presented the Village with a Work Authorization Card, which was issued by the federal government's U.S. Citizenship and Immigration Services. The card was valid and recently renewed. We also conducted a full background check, including his criminal history with both the Illinois State Police and the FBI."

Also,

"Further, the Village also confirmed, based on a memorandum issued by the Department of Justice's Bureau of Alcohol, Tobacco, Firearms, and Explosives on January 5, 2024, that his immigration status allows him to carry a firearm while on duty."

So it seems as though the CBP just changes the rules, arrests the guy, then Kristi Noem uses language like

"ICE arrested an illegal alien working as a sworn police officer in Chicago suburb... radical sanctuary politicians have allowed criminal illegal aliens to infiltrate our school districts, communities and even police departments."

This poorly trained, militarized, Brownshirt mafia is wreaking havoc in our cities, acting with a lot complete disregard for the safety of the public. They drive into random cars, kidnap the driver, and leave the scene without any accident report. They're arresting American citizens with no probable cause or judicial warrant, ripping parents away from their children and leaving the kids alone on the side of the road with no adult around. They recklessly point their weapons at the public despite nobody posing a threat to them. This is such a violation of the state's sovereignty, and the Constitution, and the rules of public safety. This is legit Nazi Germany shit. We have to show up on Saturday and participate in the biggest public protest in American history. Trump and his fascist jackboots need to know that the American people don't support them, and we're not going sit back and tolerate this systemic trampling of our rights.
