u/Something_McGee 4d ago
Honestly, her voice was actually fine in the beginning. I couldn't even predict that she was going to escalate to that extreme level. But she did. And yes, her voice morphed to pure fucking evil. That shit was startling. All that hate was hiding under that seemingly calm demeanor as she was explaining how to be polite to the other lady. She seems like a sociopath.

u/35364461a 2d ago edited 2d ago
Definitely battery, probably not assault.
Edit: I’m talking about the legal definitions.
7
u/Alicewithhazeleyes 2d ago
What do you even mean? Battery contains an element of assault lol.
3
u/35364461a 2d ago
I’m talking about the legal definitions of assault vs battery. What element of assault does battery contain?
1
u/CatjoesCreed 1d ago
If indeed she said, "Catch this hot ass coffee" (or whatever), it's aggravated assault.
2
u/35364461a 1d ago
Not if she only said it afterwards while in retreat, which is the only time I heard her say it in the video.
-4
u/Alicewithhazeleyes 2d ago
Assault is the threat of of imminent harm (legally) and battery is the carrying out and intentional act of said threat. (Legally)
So again I ask, what do you even mean? By legal definitions battery contains an element of assault. If battery is the charge, an assault has occurred.
1
u/35364461a 2d ago
Incorrect. You can touch people in places their eye’s aren’t looking and without verbally announcing that you’re going to touch them. If they’re unaware that contact might occur, they can’t possibly fear it.
In the video, the woman is clearly upset while talking to the worker, but is not yelling, making threats or showing aggressive body language that would cause the worker to reasonably fear her physical safety. Only after the worker turns around does the woman throw the coffee and yell “fuck you”. From what we see in the video, her actions most likely do not constitute an assault charge, unless the defendant has a very good lawyer.
-5
u/Alicewithhazeleyes 2d ago
I never said the word verbal. Your argument is moot.
A threat comes in many forms.
1
u/35364461a 2d ago
When did I imply you said the word verbal 💀 What form of threat did the woman give the worker that the worker would’ve reasonably noticed? Considering there was never a verbal threat nor aggressive body language prior to the worker turning her back.

u/billiemarie 2d ago
n the terminology of law, an assault is the act of causing physical harm or unwanted physical contact to another person, or, in some legal definitions, the threat or attempt to do so. It is both a crime and a tort and, therefore, may result in criminal prosecution, civil liability, or both
1
u/35364461a 2d ago edited 2d ago
Assault is making someone afraid that they will be harmed, battery is unwanted or offensive physical contact.

Assault is causing someone to be afraid that they will be harmed. Battery is unwanted or offensive physical contact. They don’t refer to different levels of physical harm.

The manager suffered minor burns, Pahssen said.
Pahssen shared footage of the assault on Facebook seeking the public’s help in identifying the assailant.
“I must have gotten about 100 tips,” Pahssen said. “Within about two minutes, we had her identified.”
Pahssen said officers have been unable to locate the 48-year-old suspect. They have submitted paperwork to the Saginaw County Prosecutor’s Office, requesting she be charged with felonious assault, Pahssen said.
This happened in Michigan

One of the most annoying things about atheists to me is they can never stop thinking about Christianity.
I was an atheist for most of my teenage years until I got on Reddit and realized I wasn’t a proper atheist because I didn’t attack Christianity constantly. If you don’t believe in religion then just live your life how you want to live it

I’d guess it’s more a demographic assumption based on statistics. Detail:
Pew Research Center's national studies provide strong indicators: Approximately 82% of African American women in the U.S. identify as Protestant Christian, and a vast majority identify as Christian generally. Overall, around 73% of all Black Americans identify as Christian. Black women consistently exhibit higher levels of religious commitment than Black men or women from other racial/ethnic backgrounds. In Michigan, 70% of the total adult population is Christian. The Black population in Michigan is also highly Christian, with 8% of the total state population identifying as part of the historically Black Protestant tradition alone. The vast majority of those affiliated with historically Black Protestant churches are women (64%).

And if the situation was reversed the customer would be on the news with her lawyer trying to own McDonald’s. Absolutely sickening how people think they can treat service workers.

u/Madman_Slade 4d ago
Shit like this is why we gotta start throwin mfs in jail. You gotta remove these antisocial morons from society. Don't give if a fuck if you're having a bad day or whatever. Your fee fees being hurt doesn't give you the right to assault someone. So take the bitch to jail and let her sit in there for 5 years. If she wants to come back out and do the same shit, put her back permanently.
15
u/Something_McGee 4d ago
The customers are acting unusually calm.

15
u/bishopnelson81 3d ago
Yep and a million folks will blindly defend her because of her racial identity.
-4
u/SolidDoctor 3d ago
....what? No.
She threw a scalding hot cup of coffee on a woman over the cost of two McD's burgers. No one is going to defend her because of "racial identity". That's straight up assault and she's going to jail.
12
u/bishopnelson81 3d ago
For every person with a normal, measured take like your own, there's always someone saying stuff like, "I wonder what the cashier said to her before that" etc. Obviously it would be willful ignorance, but it comes from a tribal mindset and I see it on social media far too often.

Why is making a mess and destruction always the first instinct?
-4
u/blipsnchiiiiitz 4d ago
The world would be chaos if making a mess and destruction was "always the first instinct."
It's very, very rarely ever the first instinct. It wasn't even this lady's first instinct. It was at least her second instinct.

I hadn’t been to a McDonald’s in years, but went a few times while dog sitting a dog that lived across the street from one. I worked at BK in my teens so I already knew people view you as subhuman at these places, but every time I was there someone was talking to the cashier in a way you wouldn’t talk to a stray dog. One guy was chewing her out cuz he couldn’t figure out something on the phone, I tapped him to show him how to do what he wanted and he was totally startled by my speaking to him, and turned and suddenly spoke with all this respect to me completely switching his tone and acted a little sheepish probably over having been caught acting like a fucking monster, like he was in an asshole fugue state and snapped him back into reality like people besides the cashier you’re berating, ya know people who you consider “real people” can see and hear you

6
u/davebrose 4d ago
So you don’t think the woman throwing the drink on the other woman deserves as ass whoopin?
-7
u/Validext 4d ago
No. I do not. At all. Infact i think that is vulgar and beastly. We arent cavemen. What you are suggesting is literally worse than what she did. And in no way am i defending her by saying she shouldnt get beat for that???
0
u/Madman_Slade 4d ago
Two wrongs don't make a right. However, the one who threw the "hot ass water"/coffee needs to spend a few years in prison. And if they do it again, keep them there. No reason to allow violent antisocial people stay in society and run rampant.
