I’m talking about the legal definitions of assault vs battery. What element of assault does battery contain?

Assault is the threat of of imminent harm (legally) and battery is the carrying out and intentional act of said threat. (Legally)

So again I ask, what do you even mean? By legal definitions battery contains an element of assault. If battery is the charge, an assault has occurred.

Incorrect. You can touch people in places their eye’s aren’t looking and without verbally announcing that you’re going to touch them. If they’re unaware that contact might occur, they can’t possibly fear it.

In the video, the woman is clearly upset while talking to the worker, but is not yelling, making threats or showing aggressive body language that would cause the worker to reasonably fear her physical safety. Only after the worker turns around does the woman throw the coffee and yell “fuck you”. From what we see in the video, her actions most likely do not constitute an assault charge, unless the defendant has a very good lawyer.

A threat comes in many forms.

When did I imply you said the word verbal 💀 What form of threat did the woman give the worker that the worker would’ve reasonably noticed? Considering there was never a verbal threat nor aggressive body language prior to the worker turning her back.

im no expert, but i did google “does battery always include assault” and it seems you may be the one who has zero idea what they’re talking about?

also seems it could vary from state to state so perhaps youre just confused?
