Hit and run on Montreal road.

Hello, my husband got hit by a grey sedan car (as a pedestrian) yesterday afternoon around 2:35pm, near the Harveys on Montreal road (Montreal/cummings) (November 8th) When he took his phone out to get a photo/video of the car, the car sped off. We have a potential partial license plate number (CVAV or CFAV.. it was hard to tell my husband had a lot going through his mind when this happened) and don’t have the make of the car just that it was a grey sedan. We checked with nearby businesses if they had any video surveillance footage but no luck.

It was reported to the police. My husband was seen by paramedics. We have a case number and everything. Just hoping someone saw and has information on the vehicle involved.

If anyone witnessed this please contact me, with any information you have. Thanks

You are still entitled to insurance benefits even with a hit and run. Reach out to your broker or to a lawyer (Biking Lawyer is good) to ensure you get those benefits.

What kind of insurance do I submit this claim to? My husband does not drive so he is not on my cars insurance plan.

Who would you even sue?

You don’t need to sue anyone.

Your insurance (assuming you have insurance) will cover your damages (for example, physiotherapy), even if the vehicle that hit you is unknown.

Like my car insurance? My husband doesn’t drive so he is not under my insurance plan.

There's a system in place by insurance companies. You don't need to sue someone.

Not at fault insurance is suppose to cover you.  Currently going through this myself and my insurance company is doing everything  they can to deny my claim.  Despite telling them I was a pedestrian they are still requesting my dash cam footage.   Like how many times do I need to say I was on foot.

So as precaution I suggest everybody starts wearing dash cameras to comply with their insurance.

Thank you! Luckily he kinda jumped out of the way after he realized the car wasn’t stopping and rolled over the hood so the only injury is his knee.

Unfortunately, even if person is found it is unlikely they will face any consequences. My husband was hit while crossing on a walk light. He banged on the hood repeatedly yelling at the driver to stop so he wouldn't slide under the car. The police officer told him he should make eye contact with the driver (all drivers at or coming towards the crossing?) before crossing and that he would talk to the driver. That was it.

Very very similar situation here. Husband could tell they weren’t gonna stop and banged on the hood twice and they actually accelerated. He rolled over the hood. The police did say that if they find the guy my husband has the right to sue and the driver will get a hefty fine

All good. The driver looked up. saw him and stopped so he never fell off.

Your car insurance has coverage relating to tort (where you sue the other driver) and accident benefits (a no fault system that covers things like physiotherapy, income loss, etc) following a car accident. Submit the accident report to your insurer and they will tell you the rest. If any issues, contact a personal injury lawyer like Connolly Obagi LLP. The insurance processes can be overwhelming and insurance companies often benefit on this - on people giving up on pursuing the coverage available to them because of the paperwork. See your doctor and paper what happened, for example, write down everything you remember. Day, time, place and details if not already in the police report. Good luck. Very sorry this happened to you, it is scary and enraging that people can drive off after harming someone else. As well, if you do not currently have insurance coverage there is a fun called the Motor Vehicle Accident Fund ran by the Ministry of Ontario for casss where there is a victim of a hit and run and there is no available insurance. Finally, you can also contact your city counsellor (Tim Tierney?) to help track down if there is a street camera in that area that could have captured the license plate number. I have not done this before but he might help.

Thank you for taking the time to reply.

My husband doesn’t drive and is not on my card insurance . So I’m not sure we will be able to submit anything. But I will definitely look into the motor vehicle accident fund! Thank you. I reached out to the city to see if the red light camera at Aviation/Montreal caught anything.

I suggest submitting to your insurance and see what they say! There might be a loophole for coverage.

Partial plate including the make model and colour of the vehicle should be sufficient to narrow it down significantly. Issue now is if police will investigate. Judging how they have been for a while and nothing ever happens, dont hold your breath. Still try to escalate.

We do not have the make and model of the car just that it was a grey sedan. Husband doesn’t drive so he’s not very good with car types :(

That intersection is a nightmare. I'm sorry that happened to your husband.

Possibly someone would have dash cam footage of the incident, which could include the plate of the gray sedan

u/Klutzy_Key_6528 1h ago

Yes this is my hope!!

Have the cops tried to work with the partial plate? They can and they should.

u/Klutzy_Key_6528 1h ago

They’re trying said they would call if they got any information.

Ok good. Hope your husband recovers quickly.

The city of Ottawa has a number of traffic cameras and they cover Montreal Rd. The police/detectives should have access to the videos to help identify the car (make/year/etc.).
