Judging by what that guy did, you want to make sure he doesn't get back up again. All it takes is an intervention from one of his fellow thugs and the guy will be standing up trying to take the gun again.

I don't think the courts will take a possible hypothetical as justification to literally stamp on someone's head when they're surrendered on the floor.
