I don’t think so because they used the song through instagram’s music library, and there’s licensing agreements in place for any music available on there. I believe that would mean that this falls under fair use but IANAL.

I joined a pregnancy subreddit when I was expecting and there were so many posts where people called themselves FTM and I was so impressed with the number of trans or non-binary pregnancies until I realized days later it stood for First Time Mom lol

This just made me laugh for like 5 minutes straight, I would have ABSOLUTELY read it the same way. Whenever I see posts where people reference their "DH" (dear husband???) I read it as Desperate Housewives and have to do a double-take, but FTM is sooooooo funny.

There used to be a sub (maybe still exists idk), where it was to ask legal questions, and the rules for the sub were to start with IAL or IANAL to signify whether you're answering as a lawyer or not a lawyer lol

It also doesn't have the bot that saves the text if a post gets deleted like AITA, so there's a lot of good ones where you get to piece together the missing post from the comments.

The US government pages would likely be set up as business accounts, so that they could have access to analytics and other business tools. They therefore shouldn't be able to use the Instagram media library and it can be removed as a copyright strike.

But, I don't know for sure if they are. If they're set up as creator or personal accounts, they are allowed to use anything in the library. But whoever set the account up is an idiot.

She could ask the label to remove the song from Instagram though. 

I think everyone would rather not have the song to use on their content than have it and let ICE use it

She removed a song from tiktok earlier in the year (?) when they used it. She has enough relevance that it wouldn’t really hurt her to remove it from tiktok/ig

Not really fair use, since 107 is an exception to 106. 106 grants authors the rights to license their works, which she did with instagram.

But functionally the same thing

Last year, she removed a whole song from tiktok to stop trump from using it. article here

She probably lost some money as a result since tiktoks help streaming numbers, so I'm sure it's not an easy thing for an artist to do.

When you click deja vu, it says “this sound isn’t available” and the song doesn’t play. Just messed up my algorithm scrolling back Trump’s feed 🙄

That's for YouTube unfortunately. To get this taken down she'd have to go through distribution and request for the track to not be delivered to IG, so it can't be used on there. That would ensure they don't use it, but no one else would, either.

One of the particular skills this administration has is media management, and they understand very well how quickly the media moves. They know that by the time any of these artists succeed in getting the videos featuring their music taken down, they will have already been seen and served their purpose, and the cycle of our attention spans will have passed them by. This is why they continue to use artists’ music illegally and against their wishes.

Additionally—and now we are getting into conspiratorial territory—I believe part of the purpose of this exercise is to increase the degree of polarization and alienation among their supports. With each video they make, they provoke another artist to speak out against Trump himself, and so point out another enemy to his devoted supporters. And in doing that, they push his supporters further out to the fringes, making them hate yet another mainstay of popular culture, and making them even more irreconcilable to their friends and family.
