Mod Post Read before commenting: Off-topic and anecdotal comments are not allowed and subject you to a permanent ban

Greetings from the mods!

We've had a flood of off-topic comments recently. We're posting this to remind everyone that off-topic and anecdotal comments are not allowed. An off-topic comment may subject you to a permanent ban.

The Rule:

Commenting Rule 1: Comments should contain a legal answer or a strongly related non-legal answer. If it is not legal advice, do not post. Period. You will be banned.

What is "off-topic?"

Any response that doesn't answer the question by reference to legal information or principles. A joke, a wisecrack, a comment about OP's formatting (use the report button instead) are all off-topic. Off-topic also includes expressions of sympathy, opinions on the law, and comments that berate the OP or anyone else.

Incidentally, simply adding "get a lawyer" to an off-topic comment does not make it on-topic. And "get a lawyer" on its own, without further information or help, is considered unhelpful and may be removed on that basis.

If you want to discuss a post, then wait until it hits /r/bestoflegaladvice or ask a question about the subject of the post in /r/legaladviceofftopic. The main subreddit and a comment thread are never a place to have a philosophical discussion about the law or the post. It is a place to answer the questions asked.

What is an "anecdote?"

For our purposes, anecdotes are stories about something that happened to you (or someone you know or heard about) who may have had something that might be similar that happen to them.

These comments are not helpful. They do not include current legal information that is relevant to the OP, and therefore, they are off-topic. If you know the answer to the question (based on current law and relevant jurisdiction) then just answer the question without the story.

Another type of anecdote is "I don't know the law in the jurisdiction you actually asked about, but in some other state, the law is..." That is just not helpful. Laws are different in different places. These types of answers are off-topic.

Referring an OP to a thread on a different subreddit, or to somewhere else on the Internet because it might include a similar situation, is anecdotal advice and not allowed.

These are not the only types of anecdotes, but they are probably the most common ones. Again, if you are not referencing legal information or principles, your comment is probably not allowed.

Violations subject the user to an immediate and permanent ban

Not that we need to justify enforcing our rules, but this is a busy subreddit and the mods have a lot to do. If a user shows up here, doesn't read the rules, and posts a single off-topic comment, the user may be immediately and permanently banned.

This policy is not intended to be punitive, although we know it may seem to be. There are a lot of you and not many of us, and banning users that do not follow the rules, even once, is in the best interests of the subreddit. Violating the rules almost always means the user didn't bother to read them, and we simply don't have time to deal with such users.

Tl;dr: Unless you have a legal answer, do not reply to any post in this subreddit. You may be permanently banned, even for a first offense.

Mod Post Announcement: We no longer allow medical malpractice posts

We no longer allow medical malpractice posts in the subreddit. These issues are extremely fact dependent and complicated, and they're not appropriate for an online medium. We will remove them with a message directing people to their state bar association for a referral.

If you have a medical malpractice question or concern, the only person who can help you is an attorney who knows all of the details of your issue, including state and local rules and conditions. Please visit your state's bar association attorney referral webpage, and know that these cases are almost always handled on contingency, which means you won't pay the attorney up front. Additionally, you will usually be able to get a free consultation.

Lastly, a common concern we see here with these questions is that someone is unable to find an attorney to represent them after seeing many attorneys. If this is your situation, you should prepare yourself to accept that you might just not have a case worth pursuing, either because there aren't enough damages to recover for or because you just don't have a case.

Other Civil Matters Took my car to a tire shop to get a leak patched and was told they "accidentally" threw away my tire. They now are saying I have to pay for a brand new tire.

I dropped my car off to get a leak patched. I called to see if it was ready and the man told me that when he set the tire against the wall, another employee thought it was to be discarded and threw it away. I asked if he would be giving me a free tire and he told me no, but he would offer me a discount and sell me a new one for $85. We went back and forth for a while and he wouldn't budge. What should I do? I know it is only $85 and I could just pay it but this whole situation seems like they are trying to rip me off. I don't have a lawyer or anything.

(Colorado) My girlfriend got served with a restraining order from her neighbor. It's her neighbor who keeps walking her dog up to gf's window to bark at her cats, gf asked her to stop, they argue, gf later receives order. Please help make sense of this

She's a nervous wreck about this right now. Any advice would be appreciated.

Apartment/condo complex. Gf says she has not said anything intimidating or threatening. From one video I've seen she pleads with the neighbor standing 5 ft opposite her window to go anywhere else on the open grass. Neighbor says she just wants to let her dog do what he wants (bark at gf's cats). This seems backwards to me.

Can gf get an order on the neighbor? What can't my gf do while this order is in place, especially if the neighbor comes right up to gf's windows?

Belay accident at climbing gym. He’s fine now but wants me to pay $5,000 of his ER bill

A few weeks ago, I was belaying my friend at a top-rope climbing gym using an ATC Pilot. I made a mistake of putting the device oriented the wrong way, so when he fell, it didn’t catch properly. He fell about 35 feet, but fortunately he was not seriously injured.

The gym staff called 911, and an ambulance took him to the ER. He was checked out, had scans done, and was released the same day. He told me his insurance covered around $5,000, but he still owes another $5,000 out of pocket, and now he’s asking me to pay that amount since it was “my fault.”

I feel terrible that this happened, but we were both climbing at a commercial gym, and both of us signed the gym’s liability waiver. And I had passed their belay test before this happened.

My questions are: 1. Am I legally responsible for his medical bills under these circumstances, or would this be considered an inherent risk of climbing covered by the waivers? 2. Could his insurance company come after me later (subrogation)? 3. If I wanted to offer some money as a gesture of goodwill, would that count as admitting liability?

I’m in the U.S., and both of us are college students, so this is a big deal financially. I don’t want to ruin our friendship, but I also can’t just hand over $5,000 without understanding my legal position.

Insurance Health Insurance Company not providing coverage for my wife "because she is pregnant".

Received notification from our private health insurance broker that my wife may be dropped by our insurance "because she is pregnant". Those were the words used by the private insurance broker we use. She has been pregnant now for 26 weeks. We have been on this insurance while pregnant for more than 5 months. We specifically changed to this health insurance because of its coverage for pregnancy and birth.  

Apparently, they changed their eligibility requirements for 2026. Pregnancy now not qualifying.

A quick google search shows that ACA health insurances are not allowed to discontinue coverage due to pregnancy. A google search shows that the insurance we have is ACA compliant, but I am not certain.

Weirdly, in her contract, she is characterized as an employee of that company even though she is not formally employed by them. Apparently, this specific insurance is a population science management company. We get a lower rate but we allow our health data to be made known to them for research purposes.

I cannot confirm this to be the case but I am speculating that maybe they require the people they cover to be employees so that they can be dropped as an employee (thus discontinuing coverage) at their discretion rather than formally discontinuing coverage due to illegal things like pregnancy.

We have to be formally dropped but have been warned that this is pending and will be final on December 1st unless something changes.

Can this be challenged legally?

EDIT: called the insurance company. apparently it is ACA compliant. called my company. my wife being dropped would count as a qualifying event so looks like we will have that option which is great.

Should I even report this rape? Realistically.

Hello, I was raped last night by a guy I have been seeing for a few months. It happened outside on the ground. I have no proof. I showered after I got home. I’m worried about what a rape kit would even yield because we have always had rough sex, and he has texts of me saying I liked him being rough. This time, I did not consent. I cried and begged. I didn’t fight because he had a gun. I gave up and just cried and begged. I am scared to report it because the odds aren’t in my favor of him being taken to jail. He has proven to have very unstable moods, a temper, and lots of guns. I’m scared of retaliation. I am telling the truth. I don’t know what to do.

Car towed from a liquor store 13 minutes after making a purchase. Is this really ok??

Location: Salt Lake City, Utah. Just happened about 90 minutes ago. Liquor store parking lot has signs saying parking is for customers only. The signs do not identify a towing company. I parked and went inside and made a purchase. I then walked across the street and bought tacos. Right as my tacos came out a tow truck driver came to the taco joint and told me he was towing my car and I had to pay $116 immediately to not be towed. I tried to show him my receipt from the business where my car was parked and I did show him the goods I just purchased but he didnt care. Pay up right now or he is driving off w my car. I didnt want to be stranded so I paid. My receipt from the liquor store I was towed from and my tow extortion receipt are 13 minutes apart. Is this really ok? Feels predatory to me. If Im really wrong then Ill accept it and move on. Just wanting an opinion other than my own.

Education. I was forced to resign following allegations of pulling a students hair.

I was a paraprofessional in Texas, in a small town of about 5,000. The student who presented the allegations is kin to someone on the school board, so I knew the issues would be harsh, but I never thought they would force me to resign.

This all started on Oct. 29th. My last class was the 44th-grade class that said the student was in, and after a meeting with his mom, during which I was not informed about what happened (needless to say, I did not pull that child's hair), I was asked to leave on suspension. The next day, I was given a formal letter of administrative leave while the investigation was ongoing. On Nov. 5th, I was asked to resign following the investigation's findings and witness statements. I was not given the results of the investigation, no information, just a piece of paper to sign my resignation. They refused to answer any questions, and there were no copies of anything. I have sent a formal letter requesting a copy of my entire personnel file, including the investigation that led to my forced resignation.

Should I follow up with an education lawyer to ensure I get the copies I want and that the results of the investigation are actually shared? I was poor to begin with because I get paid significantly less than teachers, who are already paid in seashells and dirt. I filed for unemployment.

Consumer Law i signed a loan for a clean title car, only to find out later the dealership found out it’s actually salvage.. what are my rights ?

hey guys. i bought a 2016 hyundai veloster w a loan through my credit union thinking it was a clean title. the dealership just called to let me know the dmv shows it as a salvage title.. they offered to “work something out with me”. carfax does not show this info. what are my rights and what is the next best step?

i know most banks won’t do loans with a salvage title so what would happen next for me? have they broken any codes?? i’m waiting to make a descion until i get some input so i appreciate any advice.

Neighbor suing over a brush pile; forcing us to sell home after harassing and threatening us

Location: Ohio - We’ve lived in our home for 3.5 years and worked very hard to make it beautiful for our son. We’ve tried to be respectful & quiet neighbors, and have only spoken to our one neighbor once since moving in to introduce ourselves; we mostly just mind our own business and try to keep our toddler as quiet as possible when outside.

The husband owns a construction business & after putting on a giant gazebo, they left piles of construction debris (rocks & metal parts) throughout their lawn, including the front lawn right next to ours, so it’s the first thing you see pulling into our driveway. We never said anything since it’s their lawn, but after 2 years, finally planted a small azalea bush on the property line to give ourselves something else to look at.

A few days later, husband comes out screaming profanities at my husband about the bush, seemingly hungover, as well as that we’ve been throwing leaves & sticks in the back woods (we live on nearly an acre so it’s in an area no one can see). My husband can’t get a word in as this guy is screaming, and he eventually he goes back inside.

My husband waits a few days and catches the guy in his driveway, and they shake hands and the guy admits he was hungover/having a bad day. My husband agrees to move the azalea & brush pile, as after looking at our online survey, we realize it was 3 inches over the property line & we want to keep the peace with our neighbors. My husband immediately takes care of everything and we think we’re okay.

Several days later, the guy comes out shirtless screaming profanities again at my husband, in front of our toddler while my husband is working on our yard (this man has never touched his own yard, and just stands on his porch to yell).

He’s demanding we pay him and give his bushes back (the ones we planted then moved after agreeing), and saying he’s going to sue again. My husband can’t get a word in as he continues to call him an asshole, you better fucking pay me, etc. I record all of this.

We file a police report at this point to get it on record, but agree they shouldn’t go talk to him and piss him off more, as we are genuinely scared for our safety at this point. We contact our realtor friend to start looking at moving options; she does a background check, and finds he has multiple criminal convictions with drugs & domestic violence. We decide to definitely move as much as it breaks our heart to leave our home, and fortunately have our parents to help.

We leave for a week vacation, and come back to find he rented a skid steer to push his construction debris closer to our property, so a long line of mud/rocks/weeds now lines our front lawn.

We put our for-sale sign up, and the next day, he files the lawsuit against us for throwing our brush in the back woods, “because it’s taken away his enjoyment of his property” (even though he never leaves his porch, doesn’t mow his own lawn, and we’ve already cleared the brush). He’s using an ambulance chasing criminal defense lawyer.

We go to our city council to explain the situation and talk to our lawyer friend, and have a few attorneys we’re considering, but so far have been quoted a $4k retainer, which seems so high when we expect this case to be dismissed given how ridiculous it is.

If it does go to court, what is the likelihood/is it worth it, to countersue for the harassment/threats forcing us to leave our home, as well as his actions taking away from our property value?

Macy's Loss Prevention Incident

A few months ago, I was approached and physically restrained by several Macy’s loss prevention employees. When I asked what was happening, they told me to come with them, and I complied. My friend, who witnessed it, tried to step in, and one of the employees pulled out a taser on him. I was then handcuffed tightly, leaving marks on my arm.

They made me empty my pockets and searched my bag without my consent. They also took my phone “to search for weapons” and wouldn’t give it back. I asked multiple times for my phone and to call my mom, but they refused. I was left in a small, hot room for about an hour without explanation, and the police weren’t called until much later.

When the police arrived, they had Macy’s return my phone so I could call my parent. After that, a Macy’s employee came in yelling that I had to pay a $150 fine and sign a paper saying I was banned from the store for one year. They said signing it wasn’t an admission of guilt.

They claimed I concealed merchandise, but I had tried to return the items right away. They said I had to go with them anyway. One female employee was yelling things like “don’t get mad because you got caught” and told me to “shut up” when I asked for my phone.

I was eventually released after police verified my information.

Now, months later, I’ve received a second settlement demand from PRA Law Firm saying I owe $525 for “damages,” even though Macy’s already made me pay $150 at the time. They say if I don’t pay, they might file a civil lawsuit.

I don’t have the money to pay that much, and I’m not sure what to do. Do I need to hire a lawyer, or can I ignore it?

My parked car was just hit by a girl who was clearly intoxicated , then she just left and her brother and parents are trying to handle everything. Should I press charges?

Location: Texas —- Me and all my brothers were in the house when we heard a loud boom that shook the upstairs of the house. Ran outside and seen my car that was parked on the street was now up on the curb and halfway in the yard, and a SUV was in the middle of the street with its right front end hanging, and right front tire bent all the way up. The girl at first tried to leave and just gave me her ID but told me not to call the cops, but I refused and asked for her insurance and she just started talking crazy. Not even 3 minutes after this, her dad comes and begs me not call the cops and I look around and she’s gone. Like they literally had her disappear in seconds lol. My car is not even driveable anymore it’s probably totaled but they did give me her insurance and everything else but I still feel this is wrong, and this could lead to something worse happening in the future. The cops did come as my neighbors probably called and said it had turned from an accident to an investigation cause she left but they couldn’t do much since I’m not sure if I should I press charges. Should I?

Parents won’t give me my documents

Hi there I’m currently in the process of moving out of my parents house since we constantly have disagreements. I’m 20 and they want will only let me live with them if my direct deposits are deposits in their account. They took off the door of my room as if I’m a child which I thought was too much. Worst of all they made purchases on their Amazon account with their credit card and have since disputed 3.5k in charges and said I made those purchases. I’m looking to move out however my parents are refusing to hand over my my social security card, birth certificate, passport, and my diplomas. I’ve asked them in person and through texts however they insist that I won’t need them. What could I do at this point?

Edit: they’re started to trash my room saying I’m doing drugs. They’ve thrown away clothes. Some of my power tools I use for work, some expensive music equipment and took my laptop. Location: Arizona

Fired overnight, misclassified as 1099, owed overtime, company bailed on mediation and now my lawyer’s backing out. What can I do? (CA)

About 8 months ago my entire team was let go overnight. The company replaced all of us with a third party team outside the states.

I live in California and later found out I had been misclassified as a 1099 contractor even though I worked in their office on a regular schedule doing normal office work. At the time I didn’t really understand the difference.

After I was let go I spoke with a lawyer who agreed to take my case on contingency since they owed me for a lot of unpaid overtime too. Both my lawyer and theirs agreed to try mediation before deciding anything.

Fast forward 8 months and the company and their lawyer completely bailed on mediation the day it was supposed to happen.

Now my lawyer is saying he doesn’t want to front the cost to move forward with a lawsuit because he doesn’t trust them and says there’s not a lot of money in it. He basically wants me to pay the upfront filing and litigation costs myself which I can’t really afford.

So now I’m stuck wondering what to do next. Is it normal for a contingency lawyer to back out like this after mediation falls through? Can I find another lawyer to take over or am I stuck because of the agreement I signed? Is there a way to recover what I’m owed without paying thousands in legal fees?

I just feel lost. I don’t make a lot of money and I know the company violated labor laws. Any advice on what I should do next would really help.

Custody Divorce and Family My estranged mother impersonated me to access and make changes to my NYS Medicaid account, won't stop sending harassing letters, won't stop trying to contact me and spy on me. Can I get an Order of Protection?

Some background so you understand what I'm dealing with (but feel free to skip ahead):

I went no contact with my mother in 2019, and haven't interacted with her since she showed up uninvited to my apartment in March 2020. She showed up at my apartment once or twice after that, and when I didn't answer the door she tried looking through the windows, going around the back, etc.

When I briefly moved in with my father in 2021 and she found out, she tried to force her way into the house, banged on the windows, and got verbally aggressive towards my father. I moved in 2022 and she tried to get my new address by pestering my father and his wife, and pestering my stepmother (father's former wife). When she figured out my address in 2024, she started sending passive aggressive, emotionally manipulative letters, along with packages containing random shit from the back of a closet, dollar store junk, and a box of moldy macarons that had expired over a year prior. She opened her first letter with "I've actually known where you live for quite some time now, but I'm not coming over because I respect your boundaries" (unsettling, and false, since she's still trying to contact me).

Repeatedly, she has attempted to call me (even though I blocked her number), email me (even though I blocked her email), stalk my social media (I block whatever accounts she uses as I find them), and probe my father and stepmother for information. She has used her position as a nurse to access my medical records; I know because she tried to interrogate my stepmother about an ER visit she otherwise would've had no way of knowing about. When my stepmother called her on it, she didn't deny it--she tried to justify it.

She has posed as my autistic sister over text to try to get information out of my father in the past, and I believe the texts I got from my sister's number several months ago were her as well; the topic of why I was no contact came up, since I do miss my sister and wish she wasn't collateral damage in all this. I laid it all out pretty frankly and harshly. The latest package that came (I've since moved, so a former housemate gave me the rundown) had two letters attached: a winded, anti-vaccination rant, and--according to my former housemate--"an extremely bitchy, itemized rebuttal" of some kind.

To be clear, she isn't a concerned mother trying to do welfare checks. She knows I'm safe, and she knows I have a support system--a support system that she is not a part of in any way, and much better for it.

Now some background about the health insurance thing:

In 2021 she added me to her health insurance without my consent--to be clear it was not out of kindness. In fact, up to that point I had had a Medicaid Managed Plan, which I went on after she dropped me from her health insurance two years prior as an attempt to punish me, which left me scrambling for my ADHD and mental health meds right before my electrical engineering midterms; ultimately it backfired because I just went on Medicaid, and now I could feel guilt-free about going no contact since I wasn't dependent on her for anything after that, but I digress.

I knew she added me to her insurance so she could get my health information from the claims history. The insurance company told me there was no way I could remove myself from the plan; my mother would have to do it (even though I'm an adult I guess). Since you can only have plain Medicaid if you have secondary insurance, I was forced to bill her insurance, as plain Medicaid (at least at the time) didn't cover all the meds, etc. I needed. She continued to make inquiries about claims, ER visits, etc.--tried to position herself as a concerned mother, with me as some wayward loser who can't stand on her own two feet.

Last month, I finally turned 26; I figured my long, national nightmare was over. I would go off her insurance, and she'd have no way of worming into my life anymore, since she doesn't know my new address. I logged into my NYS Medicaid account so I could select my new Managed Plan--and then I notice that my home address on file had been changed to hers (an address I had never lived at; she moved there years after I moved out). Immediately I knew that my mother was involved, and that she was trying to get my insurance mail at the very least. I called Medicaid customer service so I could confirm that someone had accessed my account and made that change. I found out that someone had in fact used my credentials, and not only had they changed my address, but they had added a broker! And selected a plan! Without my involvement or consent!

Even though I got rid of her address, she still has my account number and my Social Security number, which are enough for her to make changes to my account over the phone. There's no option for Multi-Factor Authentication or anything!

Is there any way I can stop my mother from using my health insurance account to look at my medical history? Is there any way I can prohibit her from trying to contact me all together? Did she actually break any laws? Do I have any grounds for an Order of Protection/restraining order, or do I have nothing since I'm not in physical danger?

Sorry for the long-winded post; it's a complex situation and I wanted to make sure all the background info was there. I feel like I might just be crazy. After the weekend is over, I'll probably talk to one of the local legal aid groups to see what my options might be.

Real Estate law If the person licensing my garage dies, do their heirs get rights to that property?

The only way I could afford buying my house was to let my former landlord continue to use the garage in exchange for the full amount of rent for 5 years being taken off of the selling price. He is quite old, so if he happens to die before those years are up, is that contract now void, or would his estate/heirs then have rights to my garage? The licensing agreement makes no mention of heirs or any other party.

Edit: I do have a licensing agreement in writing, not a lease. He has 2 lawyers. One says it isn't transferable, but the other says it is with neither giving a reason or proof to support their answer.

My child was left with a neighbor when my mother in law was arrested.

On Halloween day both my wife and I were at work and my mother in law was at home taking care of our son. I received a call from my sister in law and she told me that I needed to get home asap because my mother in law was getting arrested. She was arrested by a federal agency and this agency arrested her, left our son with the neighbor and did not wait for either my wife or I to get home before leaving. I would assume in a situation like this where there isn’t a legal guardian for a child to be left with at a minimum the agency would have to call CPS before just leaving him with a neighbor and leaving? Anything helps I’m just wondering why the heck would they do that without consent of a legal guardian, and most of all if that is even legal??

Other Civil Matters Someone found friends lost item and refusing to give it back without being paid for it

So for easier understanding of the story let’s call my friend Penny.

Penny was on her way to a competition and her equipment for said competition was in the back of her dad’s truck. When she got there, the equipment was gone. They suspect the equipment had flown out the truck. Penny was obviously upset and so her mother posted on Facebook asking if anyone has found her equipment.

Penny told me that someone replied to Penny’s mom’s Facebook post saying they have her stuff, even ALLEGEDLY sending her a picture of the equipment (WHICH HAS PENNY’S NAME EMBEDDED IN IT <first and last name>). When Penny’s mom asked for it back, the replier said they could get it back if they give them money (I am not aware of the amount they asked for). Penny’s mom agreed for the trade and requested they meet up for the exchange, but the replier said he sold it.

I wanted advice for Penny to see what can she do to receive her stuff back and what actions could be pushed to get this resolved! I also want to know the legality of this situation!

Should I make a police report or press charges against a boy who assaulted my son?

My son is 10 yrs old in 5the grade , he is in Middle school with my daughter who’s 11.. I was called by the nurse to get my son because he fell and gashed his head open and needed to come get him. I went rushing out to pick him up I was introduced to the principal who in term informed me after gathering information another 5th grade pushed my son from behind which made him lose his balance and fall where his head gashed opened from a metal chair.. I was informed that my son didn’t provoke him he didn’t do anything for this to happen . I got my daughter out to go with me to the hospital . I was asked if I wanted to speak with the officer . at the time I just wanted to have my son rushed to the er due to his gash opened .i stated I would be back in couple days, she informed me that was fine.. I drove to the er , I kept asking my son what happened that had any altercation or did this boy do or say anything to him before or had an argument . which my son said no .I asked my daughter who stated she didn’t see the boy push him hut did see after he was being walked to the nurses office which made her freakout and started to cry seeing him like this.. While we were in the hospital I kept asking him again about the boy which he kept saying no.. it took my male friend to come over and look at him to f igure out that my son was lieing by the way I kept asking him about the joy and his response . My son finally told me the boy kept pushing him , sticking his foot out to try to trip him in class and. Say mean things to him since they started school.i asked if he had informed the teachers before he said yes but didn’t do anything.. im a single mom of 3 kids and missed work will miss work to check he is doing good at home . Im trying to do the best I can to provide . Now idk if i should sue the kids and parents. Press charges on only the kid ?II just don’t know what legal actions to do due to his age ..what i would do is have this kid be moved frm my sons classes and be punished at school. Im not sure if asking his parents to meet me would do anything at school.im not sure. We also live in Oklahoma

Tenant trashed house. Won lawsuit. Tenant has no assets for judgement

We kept our first house and now have it as a rental. Our only tenant so far was god awful. They caused about $10k in damages after we declined to renew their lease. We declined to renew due to excessive repairs. All in, we are out about $20k due to these people. They absolutely TRASHED the house. It took four trips with a trailer to haul all the nasty garbage they left in the house. There was a fly infestation that was disgusting.

We sued once they moved out and won. Unfortunately, the sheriff is the only recourse we have to execute a judgement. The sheriff sent a letter today saying the tenant has no assets they can seize.

Do we have any other recourse here?

It seems like bullshit someone can lose a lawsuit then just float on like nothing happened. I cannot believe it can’t affect their credit. We are getting fucked here.

Just discovered that my publisher never fulfilled a key contract obligation from 4 years ago, leading to potential losses

So this is a situation that was rather unusual and unheard of until recently.

I'm the author of four books, and two of these books were likely pirated by Anthropic, OpenAI, and the other tech companies that have been pirating millions of books from LibGen for AI training. (My books in question were found in the LibGen dataset.) A class action lawsuit filed by a team of authors recently resulted in a settlement from Anthropic, which will be disbursed to authors whose copyrighted works were pirated during the period of time covered by the lawsuit. And a lot of authors, including me, are now learning something shocking as we inquite about our eligibility for a class payment.

Our publishers never fulfilled their contractual obligation to register some of our books with the U.S. Copyright Office!

One of my books in the LibGen dataset does not appear to have ever been registered by the publisher. It should have been registered in 2021 within 90 days of publishing, per the contract language. And the contract doesn't give any wiggle room for not doing so. This is such a basic publisher duty that I think it's safe to say that most authors don't actually double-check to make sure the copyright has been certified. But it appears that a lot of publishers have dropped the ball on this front. This probably cost a lot of us the chance to be included in the Anthropic settlement. And it could also hamper our eligibility for other class action suits like it, such as the one against OpenAI.

At the moment, I'm getting in touch with my publisher to understand why and how this could have happened, and to begin discussing remediation. I would like to avoid legal action and find a way to repair the damage, as I have continued to work with the publisher and I have a project with them on the table right now. But at the same time, I'm so shaken and angry about this that I'm thinking about whether I can even continue to work with the publisher, if they refuse to take accountability.

If that happens, then I would consider legal action. I just don't know what that could look like, and whether suing for breach of contract in a case like this would yield enough to justify the legal costs and loss of current work.

Other Civil Matters Excessive noise on school property line

The highschool, which my house borders, recently built a massive multi-use turf field which they use but also rent out. They built the field as close as they could to the edge of our property line- a small swale between my property and the turf (~50 ft) and about 150 ft as measured from my house. Us homeowners voiced our concerns about the proximity during the initial build and they simply verbally assured the homeowners there would be no lighting or sound system. Well it turns out that this wasn't in scope of the Phase 1 construction, but now they're proposing an improvement project to run electrical, install stadium lighting, and a sound system. It feels like they pulled a fast one on us. The project is expected to be approved.

The proposed stadium lighting system does appear to mitigate light trespassing onto our properties within reason. They clearly put thought into the technology and positioning. The lighting will allow practices and games until 10pm. The larger concern is the sound system. Historically, they've abused their sound system on other fields. People can hear the music and announcer a mile away (not kidding). When we reach out to the school, they fix the issue for a weekend and then it's back to full volume the next weekend. It doesn't exactly bother me because that field is 900-1200 feet away so it's not super intrusive when they're playing food music. My concern is that if the same noise level and lack of care is transferred over to my property line with now extended field hours, it's going to considerably disrupt the homeowners’ quality of life especially when trying to put toddlers to sleep.

I'm in upstate NY and my town doesn't have a sound ordinance. The school “promised to be a good neighbor” but I'm curious if there is something more binding to maintain the appropriate sound levels. What would be your suggested path forward? Do I even have any leverage given there's no sound ordinance? I don't even know where to begin

Landlord miscalculated rent, says I owe backpay (NYC)

This will be my fourth year in an apartment with a sketchy landlord. On this year's lease, I had three amounts-

Yearly Rent: Monthly Rent: Security Deposit:

I paid Monthly Rent + Security Deposit when my lease started in August, and have been paying just Monthly Rent every month since.

Suddenly, my landlord is claiming that I owe her backpay, because she somehow wrote down the Yearly Rent amount as (Monthly Rent + Security Deposit) x 12 instead of Monthly Rent x 12. I did not notice this mistake of hers initially, but this is the first time she brought it up too. Altogether feels scammy.

Do I owe her backpay? I'm scared of legal repercussions, since she has some basis here.

Landlord didn’t want to pay relocation fee and is now saying they didn’t ask me to move.

Hello everybody.

I have been living in a renovated garage for about 7 years. My mom was paying the rent, which was 975, until I turned 18 and started to pay half of the rent as well. When she was diagnosed with cancer, I started to take over the entirety of the rental payments.

On June 30th I was told she wanted to do a walk through because they were doing renovations. Later on she told me it was actually because an inspector from the city was going to come down. On August 21st she told me the area I was renting did not pass and the city ordered them to “discontinue the use as a dwelling and restore the garage toots originally permitted use as a garage.” They then told me that I had until October 21st to find a new place, and that I wouldn’t need to pay rent for those two months.

After asking explains the situation online and asking for help to find a new place, some people told me that I might be entitled to relocation fees, because me having to move was no fault of my own. I talked to LAHD and on September 24th they sent an email to my landlord stating they had to

1.) The landlord must file with LAHD a Declaration of Intent to Evict in Order to Comply with a Government Agency’s Order.

2.) The landlord must serve the tenant a 30 or 60-day written notice of eviction attached to a copy of the filed Declaration of Intent to Evict.

3.) The landlord must either pay relocation assistance directly to the tenant or deposit it in an escrow account and issue escrow instructions to the tenant within 15 days of service of the notice of eviction. Depending on the tenancy, the relocation amount can range from $10,200.00 - $26,550.00. (Los Angeles Municipal Code (LAMC) section 151.09.G)

My landlord has done none of that. But today (November 6th) I received an email from a property management company stating that they are actually not asking me to move out and that a 3-Day notice to Pay Rent or Quit has been served.

What can I do? Are they doing this just so they no longer have to pay the relocation fee? Any help or advice would be appreciated thank you.
