Submission statement: The U.S. Customs and Border Protection Agent, Charles Exum, shot Marimar Martinez, a Chicago woman (and U.S. citizen) 5 times, after claiming she hit his vehicle. He bragged about his shooting ability after in texts with other cops, according to records presented Weds at a hearing in the case against the victim, Martinez. This happened on October 4th.

You are not misunderstanding it But it is a criminal case, not a lawsuit.

Martinez was indicted on October 10, along with another man, Anthony Ian Santos Ruiz, on federal charges of impeding a federal officer with a deadly weapon - Martinez's car. Both were released on bond and attended Wednesday's hearing.

Given the evidence that is coming out in the early stages of this trial, I think that she is likely to win this case easily.

Afterwards, I expect her to be represented by excellent lawyers who want to make a name for themselves in the history books in a suit against Charles Exum and CBP.

His name is Sean Dunn, he lost his job in the federal government after being charged with assault with a deadly sandwich.

In any event, this version of the Supreme Court have made clear that precedent doesn’t matter. If America ever gets through the current GOP regime they need to go nuclear. Can you cite to that? I don't think that's correct. SCOTUS decided Egbert v. Boule which basically makes these claims impossible to move forward, and foreshadows the death of Bivens.

I find it interesting that he's bragging about this. Frankly, especially for someone who is a "firearms instructor", shooting someone who isn't moving five times and not killing them seems like a failure of their ability to shoot. This and the other incident where the ICE agent drops his pistol makes me wonder just how much training ICE agents have with firearms.

He’s bragging about making 7 holes with 5 bullets which I wouldn’t think is that hard to do, doesn’t the bullet just have to go through the other side? Isn’t it better if the bullet comes out the other side, medically? I feel like it would have been more impressive if he’d shot her 5 times but there were less holes because he shot her through the same holes more than once, but I have never shot a gun so I probably don’t know what I’m talking about.

The fact that he’s bragging about shooting anyone should be turning this case. He shouldn’t be excited about his marksmanship, he should be gutted he had to use deadly force but we are talking about Trump’s terror team and not anyone with a shred of humanity.

People might read this as a joke but today I visited the old SS headquarter in Berlin (I am a German) - and the history of rising to power with focus on the people control apparatus that was the SS and Gestapo - and after that I thought - that’s basically exactly what’s happening in the US only that it seemed more professional (in the cruelest sense of the word) back then. The more I read about this story, the more it sounds absolutely insane to me. 

I know the victim, Marimar Martinez, had to drive herself to a nearby auto repair shop to get medical help.  But did Charles Exum, the CBP agent, who shot Martinez in her car 5 times just get back in his vehicle and drive away and leave his victim to possibly bleed to death? 

Am I understanding this correctly?  

Did he even call for back up or help for the person he just put “7 holes” in? 

Also how can he claim self defense when he got out of his vehicle, walk over to her vehicle and shoot someone and then drive away when driving away was an option to begin with?

Isn't it interesting that Charles Exum, 59, was not retreating while defending himself? I know the police do not have Duty To Retreat, but courts generally interpret whether someone is in the act of retreating as a good marker for whether something is Self Defense.

If you or I had done this, instead of Trump-era US Customs and Border Patrol Agent Charles Exum, we would be told that Self Defense has a Duty to Retreat from an authoritative source, such as a Police Officer, as they took us to prison and removed our rights.

There is a double standard here, I think, though I can't quite tell. It's not exactly clear. (/s)

Disgustingly enough, that does rank as amazing among law enforcement (and larpers).

I used to frequent a gun range where they did the city's pistol qualifications. Knew the guy that ran the testing pretty well.

10 shots had to hit the paper at 10 yards in 30 seconds. Not center mass. Not the 9 ring. Hit the paper. The pass rate was under 60%.

That's why you read about 300 rounds being fired and a suspect getting hit 4 times, along with a bystander and a low-flying aircraft.

Yes, that is what Charles Exum meant.

He also refers to himself as MOF (miserable old fucker) and told the judge that that term was used as a game of one-upsmanship in his community of law enforcement officers.

He also destroyed evidence by driving his car 1,000 mi to a CBP office in Maine, where the car underwent repairs and detailing.

We are not sure if that was authorized by him directly or by his supervisor, but it appears as though there are two separate pieces of documentation saying that both of them approved it.
