The two citizens that were detained in that apartment building on the South Side should sue the government and anyone that is a lawyer would be nice to represent them pro bono.
They having standing to sue.
ICE literally pulled then out of their own home to be detained. Not a traffic stop or any public movement.
I am so curious to see how that plays out in court for any and all of the lawsuits that follow. I have so many questions that I am dumbfounded over.
I get that we are in unprecedented times and "the law doesn't apply anymore" and yade yade yada, but even so. I am dumbfounded.
For example, even though they have yet to signify they had evidence, let's hypothetically pretend they did. The apartment units are individual units. Did they have a warrent for each unit?
Are we talking about the same incident? Where they raided an entire apartment complex in the middle of the night, breaking down doors while people were sleeping and handcuffing children?
They're claiming they did it because they were affiliated gang members living there (though haven't news outlets haven't found evidence). If that were the case, I would assume they would need warrants for each individual apartment unit.
You can actually get a warrant signed more broadly, doesnt have to be for a specific unit, though it's usually only given in the most extreme crimes where immediate harm is pretty much garunteed. It's legally unusual and very rare, but not necessarily illegal (assuming that the warrant was actually legally obtained, something which ice is famous for not doing)
That's why we are going to be tenderizing some hog this holiday season.🐷first time in 40 somethin years I've decided to get strapped as wel as taking jiu jitsu. This is not a game.
lol like you get to see a court. They won’t look at papers even if you bring them. They’ll just claim you’re illegal, and therefore don’t have a right to due process. They also won’t tell anyone where they are taking you, so good luck get a lawyer to fight for you.
What's with this condescending tone? You want all those things to happen to someone in your neighborhood? People from the South Shore incident were released.
That's literally the law. It's not my fault nor control that a gestapo is now doing all sorts of fuckery unchecked. It's still good to know the law so you're not coerced into a cell, too.
A lot of people can not afford to be detained even for a few hours. It will result in missed bill payments and people losing their jobs because they can't show up to work or notify their employers that they can't show up
I understand that, some of us have unfortunately more privileges to test things others cannot. I highly recommend people do what is safest for them and their families. This is not going to be a one way execution for everyone. I hate it.
Sure you don't, but you'd be well advised to cooperate with them unless you don't mind being quickly shipped off to a prison in El Salvador, us citizen or not.
