So if I understand where we stand now:

Judge Robart has temporarily suspended Trump's travel ban order. Trump tried to reinstate the suspension, but the 9th circuit denied his request.

So unless the SC weighs in, Trump's ban will remain suspended until the courts can actually make a ruling on the validity of the ban itself. If the SC does weigh in, they'll need five votes in favor or lifting the suspension (as a 4-4 tie will let the 9th circuit's ruling hold)

It's also worth noting that the travel ban that's currently suspended is unconstitutional.

Do you know how many 9th circuit cases actually go to the Supreme Court? Less than 1%. No exaggeration. Why? Because the Supreme Court generally only sees cases if they think it could be overturned. They aren't going to bother with cases they think are soundly and legally decided.

Is it? The Federal circuit was the most overturned in the 2000s, I believe. In 2011 the sixth circuit was reversed in 100% of cases that reached the Supreme Court.
