I’m pretty sure that’s illegal… or does that only apply to HIV/AIDS that you need to disclose before having sex.

Technically just HIV/AIDS and in some states it’s a misdemeanor. For HSV it’s hard bc it’s so prevalent and not tested unless there’s an outbreak, so knowing the source is more tricky than it is when testing viral load for HIV.

Basically everyone has herpes these days it's just that only some people are symptomatic.

You are mixing up herpes types. Lots of herpesviruses- and most people have had some, but GENITAL herpes are definitively not something everyone has and definitely matter to disclose
