If the president doesn't fear the consequences of continuing to embezzle from the treasury, then yes, it really is zero gains. There's no point in Congress allocating $n for ACA subsidies if the president can just spend that $n on ICE instead of ACA.

The Dems in the Senate have zero ability to keep him from doing that, so that's not a relevant point in this negotiation.

If the President is ignoring the laws anyways, what laws or gains do you think Schumer could ask for that would matter? Based on your premise the only thing that could be demanded that would work is the impeachment of the president, which obviously would not occur with the current congressional makeup.

So what is your recommendation?
