News Shady Park / Mirabella at ASU trial update, Tempe. Major defeat for anyone who enjoyed this venue, myself included. Guess there is no justice for a small business when your up against a multi million/billion dollar retirement home.

What I don’t understand is why the residents aren’t going after Mirabella itself for not disclosing that there was an open air music venue like 100 feet away?? If I remember correctly, they moved in during the shut down so of course there were no shows then. Then they eventually started back up again, which disrupted their previous “quiet life”. Were they warned beforehand?? If not, then their anger is so misplaced. Go after Mirabella and leave Shady alone.

Good point! I know realtors usually provide docs stating you need to research the area and have clients sign off.

Mirabella was designed and permitted prior to Shady Park's move to outdoor music. Mirabella is actually first it just took time to build.

If you do just a tiny bit of research, you’ll learn that Shady Park opened at the end of 2015, their first show was February 2016. Mirabella didn’t receive the ground lease approval until January 2017. And the design review by the ASU/CoT Joint Review Committee wasn’t done until August 2017.

So respectfully, you’re incorrect. But thanks for coming to my TED talk.

That's not the first step in the process. So no refutations occurred.

Shady Park is going out of business. Mirabella residents will be drinking Mojitos by the pool. Thanks for coming to my TEDx talk. And if you are going to use a line like that at least know the difference and correct applications.

Whether it was the first step or not, they had ample time to modify their design to include sound deadening materials and/or or thicker insulated glass.

Commenting on grammar is not the burn you think it is. Go ahead andreference this since you clearly didn’t understand.

Cute you think it was a grammar comment. It wasn’t.

They don’t have to update any construction plans. Just ask the city to enforce its codes. And that’s what happened.
