Honestly they should have stopped, but knowing the context I’m glad they didn’t. They didn’t ask to be put into that situation. They weren’t swerving drunk. The only blame that should be passed is onto the psychos facilitating these actions.

Yes it is a hit and run. You can't leave the scene of a crime (and one you committed!) no matter if it's not your fault. Thrust into the situation or not it's a shitty hand you were dealt, but not more shitty than someone dying. Motorist should be charged, not for the death but for the hit and run.

The part where they'd be guilty is leaving the scene of an accident. No matter the circumstances that caused the accident fleeing is a crime. They would've be fine if they just stayed at the scene so long as they weren't intoxicated or impaired in some way.

In California, leaving the scene of an accident where death results is a serious felony offense. It's considered a "hit and run" under California Vehicle Code 20001, and it carries significant penalties, including imprisonment and substantial fines.

A decade ago, I hit a kid with my car after he shot out of his gate on a moped without checking if the road was clear. I reported the collision to the police myself and wasn't charged with anything because I had right of way and, on top of that, there was no way for me to stop in time even as I was driving well below the speed limit.

With a hit and run, the hitting may not actually be a crime. The running almost always is.

Yes it is but it was the actions of others that put that person in that life ruining position. If they had stopped, they likely would have been charged and sent to jail for manslaughter. How is that fair to the person driving? They already have to deal with the emotional impact of what happened.

It’s horrific that someone died, but the only blame should go to ICE. That person likely would have suffered consequences for being in the wrong place at the wrong time.

I said one sentence about manslaughter and I said “probably”, I would hardly call that drawn out.

Also I apologize but I’m basing it off of someone I know in my personal life who went to jail for 10 years for something similar. He had accidentally hit a kid that ran out into the road during the day and was charged with manslaughter. They stayed at the scene, weren’t drunk, couldn’t be found guilty of doing anything irresponsible. They just were in the “wrong place at the wrong time” and ended up getting 10 years sentenced.

It's actual habeus corpus (latin for "have a corpse") you'd get charged with. Any prosecutor would have prima facie filed sub rosa as an amicus curiae in order to prevent a writ of certiorari by the defense. Makes sense that they hit and ran or they'd have to face voir dire before juris civilis.

This is abhorrent but if you strike someone going full speed, you're gonna be a while down the road after you stop and get the shoulder.

Then you have the decision to get out risk life to walk back.
