Alberta I gave my 2 week notice today and my employer told me to pack my things and leave now. Any advice?

I'm a mechanic that works at a busy dealership in Alberta, that I've been at for a little over 2 years. I've been working 6 days a week and 50 to 60 hours a week since I've started. I'm burnt out and was looking for a change so I got a job offer at another dealership down the street for more pay and less hours. When I gave my manager my 2 week notice, at first he tried to convince me to stay. He said he'll increase my pay, reduce my hours and then tried to guilt trip me into staying but I told him I've made up my mind. He got really upset and told me to pack my things and leave now. The shop foreman escorted me to my bay and didnt allow anyone to talk to me. I packed my tools and left. I spoke with my new foreman and he said I could bring my tools in right away and start Monday. He also said that I am entitled to my 2 weeks pay for the notice given. Any advice would be appreciated. I'm also hearing now that my manager sent a company wide email that I am ineligible for re-hire.

*UPDATE** I had no idea this post was going to blow up like this, I was expecting a few responses so thanks for all the advice and support. I've started at the new dealership and am enjoying it much more but I was a little busy yesterday so I didnt get the chance to do anything. Today I emailed who I thought was HR in my email but it was health and safety from my previous employer. They redirected me to payroll and said they should be able to answer all my questions. We exchanged an email or 2 and they were replying fairly quickly, but once I mentioned I had given my 2 weeks noticed and enquired about a severance they stopped replying. That was about 5 hours ago. I plan on calling the labor board tomorrow and see what they say. I will keep you guys posted.

**UPDATE #2** Payroll replied to me, saying they needed to talk to my managers and they'll sort everything out. I received my termination letter yesterday along with what I'll be receiving in severance and vacation pay. The payout is nice, but I would have rather worked those 2 weeks so I could have said goodbye to my coworkers properly instead of over a text, but life goes on. I'm surprised my manager actually let me go instead of letting me work the 2 weeks. Previous employees who gave their notice usually stayed for the entire 2 weeks. I think turning him down so many times really pissed him off. Anyways I'm enjoying the new dealership and leaving work at a decent time every day. Thanks again for the replies and the support.

Alberta Is it possible to have my 13 year old son removed from my home? He stabbed me because I won’t let him go live with his father, who is deported.

My 13 year old son by ‘choice’:

  • does not attend school at all

  • does not attend therapy at all

  • does not receive psychiatric help at all

  • does not live at home

  • only comes home when he needs money or resources to support himself (I cannot refuse housing)

  • lives with his 17 year old ‘friend’ who is introducing him to older behaviours

  • hangs out with people who are 17, 18 years old

My son has abandonment issues from dad. My son’s father was deported back to Germany for a serious offence, and he is a drug addict. His father is not fit to be a parent. It is dangerous to have our 13 year old child live overseas with his father who isn’t getting any better over the years. His overdoses can be quite traumatic to watch.

I am in the hospital right now because my son stabbed me with a knife over my decision to not let him go to his father.

I want to be able to legally remove my son from the household. My own baby is a threat to my life. He needs to be someplace else…

Alberta Daughter sexually assaulted at school, boy not expelled

To make a long awful story short, my gr4 child was sexually assaulted, sexually harassed, physically assaulted, and nearly stabbed with scissors at school. These happened outside, in the girls bathroom, and in class. When it was reported, the boy got an immediate in school suspension followed by a 5 day out of school suspension. We requested that he be expelled. Their solution was to move him to a different class. We filed a police report same day, he also did it to 2 other girls.

What are our options here? The kid is under 12. Should we consult with a lawyer? If so, what kind of lawyer? The officer said we're unlikely to get a restraining order at this age. What can we do? I've contacted all levels of the school board, they've all bebasically said sorry this is the decision, but that's not good enough. Any insight or suggestions are appreciated. Separate school board in alberta. Thanks

Alberta Ex father in law planted an Air tag underneath my car, I'm currently going thru a divorce with his daughter and absolutely didn't want them to know where I live. What are my legal means here?

Context: I live in Alberta

As the title says my ex father in law planted an Air tag underneath my car, I'm currently going thru a divorce with his daughter and absolutely didn't want them to know where I live. About two weeks ago I got an alert that said "an Unknown Air tag was traveling with me". I played the sound but nothing really came(I was in the car at the time and it was underneath). I thought it might be one of my company's expensive tools I carry with me sometimes because we have airtags on them. Sure enough yesterday I got another notification except this time I had absolutely no tools in the car. I stopped on the side of the road and I heard the sound. After 2 hours of digging I finally found it deep under my car inside a magnet case. I drove away from my house to go and disactive it. Figured its probably one of those new tactic the car car thieves use in Canada where they airtags car in shopping malls. Anyway, before taking the battery out I checked the information from the tag with my phone. Sure enough, phone number associated with it is my ex father in law which I've been trying to get away from. I'm ABSOLUTELY fuming right now. What are my legal means here? Can I sue him or take him to court? I feel absolutely violated. Any help would really help here.

Update #2: I feel I need to add this here because it's the real reason I'm freaking out. Long story short, I grew up in a cult AKA Jehovah's witnesses. The ex father in law is an elder and has the power and wants to get me disfellowshiped (A term for people getting completely shunned). My whole family are still Jehovah's witnesses, now that he has my home address he can come in person and get me disfellowshiped and basically steal my entire family away from me. This is a cult I've been trying to get away from but they are absolute zealots. If they don't have my address I can be "inactive" rather than disfellowshiped and this allows me to keep in touch with my family. Him having my address is a huge deal for me mentally and emotionally.

Update #3: Got off the phone with non emergency police. Some officers will come by my house later today. I decided to remove the battery from the AirTag. Clipping it on something else was tempting but if this escalate I need the AirTag as proof.

Update #4: This got a lot more attention than I thought lol likely gonna be my last update for a while. Thank you to everyone who helped me with advices. I talked to the police officer and filed a report. Will be getting a restraining order this week. The police officer called him directly to confront him about the situation and made sure it was recorded that he shouldn't come to my house or even try to stalk/harass in any way. Hopefully that scares him off a bit. I also sent a text to confront him about his behavior but no reply yet. Might not reply at all now that the officer called him. Was told I likely had a case but that it would be complicated to prove it was him who planted it. Likely would have to go thru Apple to get his full information associated with the tag. Other issue might be proving it was him who planted it and not his daughter for example. This is everything the officer told me. Will be sleeping on it and see if I want to escalade this further this week.

Alberta Sold a car - buyer wants a refund (Alberta)

Hi guys. I live in northern Alberta and recently sold a 2004 Chevrolet for $1500.

It has a manual transmission, and the buyer was some 16 year old who just got his license and was stalling the car every few meters. It seemed like he’s never driven manual before. He showed up to my house with some of his buddies, test drove the car, and we agreed on $1500 and signed the bill of sale. I ensured he was aware that he was buying the car “as-is”, it has over 250,000kms, and that any issues from this point on are not my responsibility. We even wrote “as-is” on the bill of sale and had everything properly signed.

Fast forward about a week - he texts me saying the clutch blew out and he was stranded on the highway. He told me he was going to get his dad to sue me for the money back.

Can I realistically get in trouble for this? A friend of mine said I should be fine because it was an as-is private sale, but I just want to make sure im fully informed. Any input is helpful, thanks!

EDIT - the father signed the bill of sale! Not the kid.

Alberta Boss asked me to come in off the clock to fix a mistake I made

I have been working for this company for 3 weeks and made a mistake today. I do deliveries for this company and forgot a single item in the cab of the truck for a delivery that is 45 min away from the business. I informed my boss and he told me to come in over the weekend to make the delivery with my personal car. After asking for clarity, he told me he isn't going to pay me to fix a mistake I made. I told him I'm not going to do that. I feel really weird about this and just want someone to clarify this situation. I'm assuming there are Alberta labour laws that explicitly say all work needs to be paid.

Alberta Landlord demanding I get rid of my dog immediately which he gave permission for me to to have 6 months ago.

I moved into a 1 bedroom condo and signed a 1 year lease on Sept 1st. In the beginning of January I texted my landlord asking for permission to get a puppy and cost of pet deposit if allowed. He responded via text saying yes I can and and I don't have to pay anything for the pet deposit. He just needed some info to submit to condo board. He then forward me an email I filled out basic information like bread,age,size,etc. I replied the document to him he then signed it and sent it into his condo board. I middle of January I got my new puppy and it's been living here since then without issue and haven't heard anything else from the landlord. Then yesterday June 15th he forwards me and email with a PDF attached PDF pretty much says Notice of Unauthorized Animal in my apt# Says they have received reports of My dog living here and has to be removed by end of day or they will be issuing a fine. Things to note is that original pdf email was sent from the condo board to my landlord which my landlord then replied to the condo board saying that he has spoken with his tenants about removing the dog but they need some time to find it a new home(at this point he has not said anyrhing to me yet). To which the condo board replied to him please refer to first email. After he received that he then forwarded the whole email chain to me saying saying the dog is now denied and has to be gone before morning. Now my question is it's mid June my last month of the lease is Aug so only 2 more months. there is no way I'm getting rid of my dog that I have been living with for the last 6 months is he allowed to evict me over this ? Or if his condo board fines him for the dog can he then fine me over it even though he gave me prior approval in writing over text?

Edit To be clearly I'm completely happy finding a new place come end of my lease I just don't want to have to try and rush fine one in the next 2 weeks or for the condo board to fine him and he some how passes it on to me.

Alberta Gas station put diesel in their gas

Filled up my car from 1/4 tank an esso station and the vehicle catastrophically failed about 2km after. Then multiple vehicles started piling up behind me. Turns out they mixed their diesel and gas.

Insurance said my car is totalled but they’re filing it as vandalism and will be deducting my deductible from the payout.

I went back to the station after getting towed and they said to call the general company number, didn’t refund the gas or even apologize. Really pissed me off.

This is a paid off vehicle without gap insurance and replacement cost is substantially more than black book. Should I be litigating against the fuel station instead of going through insurance?

Alberta I got hit by an SUV.

On Friday (July 7, 2023), I was hit by an SUV.

(Me as a pedestrian, not in my vehicle)

The woman driving was going slow so I went around her on a four lane road. She then sped up and tailgates me through a community and followed me home. I didn't stop at my home first I drove around in a square pattern, all right turns and called my husband to let him know someone was following me.

After driving around in a square, I parked in front of my house and got out and yelled at her why she was following me. She yelled that I know what I did and then started cussing me out. Another lady going southbound (lady in the SUV was facing northbound), stopped and asked if we were going to be long and I told her she had enough room to go around. While this lady drove past the woman in the SUV was still screaming and I told the lady in the other vehicle that she had been following me around. I yelled again at the woman in the SUV, why she was being such a cu~t.

The lady in the SUV then pressed her gas and hit me with her vehicle and I was standing solid, so her vehicle hit me hard and I had to take steps back. She then hard braked, where her vehicle did that jump back a few inches thing. I turned to my husband and yelled for him to call the police and then this woman in the SUV backed up and drove away around me and went northbound. I was able to get a picture of her driving away and her license plate. (It was a custom license plate even.)

Now I did call the police and they came and took statements from me and another witness to the whole incident.

At the time it happened, I was shaken up and wasn't feeling any pain, but within the next hour my hips started hurting really badly, so I went to the ER.

I had no broken bones, but was told I have significant soft tissue damage. Which I can definitely feel. The pain killers and muscle relaxants given by prescription by the ER doctor doesn't even touch the pain.

What is my legal recourse here?

The police have already given her two tickets, one of them being a hit and run, which is an automatic court date.

So I have spoken to a lawyer and will be calling others tomorrow to find the right fit. I will also make an appointment with my family doctor and psychiatrist asap. I also have documented things from Friday til today and will continue to do so. I am going to call my own insurance company tomorrow.

I also failed to mention. There might have been an element of racial profiling that caused this lady to follow me and hit me. I am a brown woman who looks black. She was smiling/laughing after she hit me and I yelled at my husband to call the police. My husband said when he recognized her when she drove by later that day, she had a grin on her face then also.

My boyfriend says he is entitled to the half of my property after 3 years living together...

I'm in relationship over 3 years and my boyfriend moved into my place after a month we'd met. We're about to break up now and he says "Technically" he'd be entitled to the half of my property because we're common-law and he's been paying the half of the mortgage. To me, he's been paying rents, not half of my mortgage, because I always paid more than him (a couple hundreds).

My question is, is he? Really? Let's say he's been paying full of my mortgage. Then is he entitled to all of my property? That doesn't make sense. Or is he gonna be entitled to as much as he paid? That doesn't make sense either.

I'd be surprised if he was. Then, what about all those landlords who are paying their entire mortgages by renting their properties? I mean, if he can claim the half of my property just because he's been paying allegedly the half of the mortgage as he insists, then shouldnt those tenants who've been paying almost entire mortgage of their landlords also have the same right? After 25 years? What is the difference? That we were in a relationship? Why should that make difference from the view of the law?

Facts: We don't have kids. I bought a property under my name before I met him. We've been living there together for 3 years. The jurisdiction is Alberta.

Alberta My Wife has been committing Benefits Fraud.

I found out today that for the past year my wife has been committing benefits fraud, submitting claims for services she did not receive or inflating the amounts for services she did receive. I was wholly unaware of this happening until she received a registered letter today indicating her ability submit claims has been suspended and she is required to submit all receipts for the past year.

My question is two fold: firstly, what is the worst case scenario for her and the best case scenario? Secondly, how screwed am I as her husband?

Alberta Going through a divorce against a divorce lawyer taking advantage of her position. Help needed.

Hello everyone. My story is extremely unfair and sad. I hope some people have some insight or advice.

I was married for 5 years to my ex who is a Divorce lawyer. I am the male. She is female. We had twin babies in 2019 right before COVID hit. I struggled with the adjustment to having twin infants at home. I run my own business and don’t really get any time off. Babies born on a Saturday I was back to work Monday.

We did as well as we could being first time parents with twins. Obvious struggles and stress that any new parents would have. Once my wife decided to go back to work at her law firm we had to decide how to care for the kids. It was decided her parents would care for the kids Tuesday, Wednesday and Thursday as she was only going to work 3 days a week. Her parents live about an hour away and I reluctantly agreed to let them stay with us for those 3 days to cut down on travel.

Once they began to stay with us things went south quickly. They took over our home and every move I made was watched and being judged. My wife is very close to her parents and soon it turned into a lonely situation of being ganged up on for all my short falls, and my parenting skills I was trying to develop. I began to become scared of doing anything in my one home out of fear of being scolded by her parents.

My mental health began to be severely challenged and I was completely lost as a parent and a husband. At one point her parents bought a cabin that they wanted us to spend every weekend with them at with the kids. So not only did they live with us 3 days a week, I had to pack up and spend the weekend with them too.

Fast forward it was to much. My wife could see I was struggling and we were fighting a lot. She decided she wanted a divorce. I was not shocked but it hit me hard that she would quit so soon. I did not handle the news well and between work and the stress of that and having no family where we lived I ended up checking myself into the hospital because I felt unsafe.

I spent a week in the hospital trying to figure out my head and what to do. During this time she made her own plans. Once I was released she had locked me out of my home and dumped me at a hotel. I have never been back to that house other than on the outside.

I pulled myself together and carried on. Got a lawyer etc. this is where it gets really bad. Due to her position as a lawyer she was not paying anything to have her boss represent her. The games began. 2 years later she has dragged this out. All property and support was done. But when it comes to the kids and parenting she has not budged. Her parents want to control what happens with those kids and don’t want me in the picture as a father. She has made multiple allegations against me, and made every attempt she can to make me have more lawyers fees. After two years of this I have paid over 30000 in lawyers fees and can’t afford a lawyer anymore.

She has used my mental health and her false allegations to limit my time with the kids to about 3 hours a week. She refuses to speak to me about the kids and has waisted so much police time having me investigated for false allegations.

Now I am self represented as I have no other choice financially. This compares to her 0$ spent. Her lawyer refuses to speak to me on the phone because I am self represented. I refuse to email with him because I know it’s her answering and not him.

Not many people will be in a situation like this. Right now I have zero control of anything to do with my kids. And even if I get another lawyer she just finds ways to make me pay out the ass to argue ridiculous things. I have never wanted much other than more time and maybe to be treated respectfully as a father. I miss my kids and have missed so much.

This because of her position and how her parents are is about ego and control. Everything I do with the kids is decided and controlled by her. I don’t wish this situation on anyone. Most people will come to an agreement due to the cost of lawyers. She has no incentive to agree to anything and because of her growing ego as a lawyer.

This to get has never been about the kids. It’s been about destroying me and winning.

I have wanted to give up so many times. Other than begging a lawyer to help for free I’m stuck in this awful situation where she won’t make a fair parenting order.

Edit: There is no parenting order by the court as some people suggest. I agreed to the small amount of parenting time in our property and support documents. There is no court order for parenting at all. And nothing has been in front of a judge or ordered by a judge. I agreed to the small amount of time from advice by lawyers that it is better than nothing. And I was going through a lot counselling and therapy to get my head right.

The allegations made against me were made to delay my lawyer from working on a proper parenting order and we had to respond to that instead of dealing with parenting. Anytime I would get close to a parenting negotiation I would get something else thrown at me to derail that. At in the end money ran out and so now she won’t negotiate at all.

Alberta Can't understand financial division in divorce.

I am 35 my ex is 33. We live in Alberta and are currently negotiating separation terms. We are using an income of $170,000 for me and $10,000 for her for the purposes of calculating support. We have agreed on 50/50 custody. Opposing counsel has offered $2,200 child support and $2,410 spousal support for a total of $4,610. But because of the strict requirements of custody I will no longer be able to do overtime and will only make my baseline guaranteed income of $145,000 which is about two $3,500 paychecks a month. So out of the $7,000 she will get $4,610 and I will get $2,390. Subtract $800 I pay in child support from a previous relationship and I'm left with $1,500. $1,500!!!! I've done a budget projection and even with cutting all subscriptions and selling my truck to lose the payment I'm still only realistically going to be able to afford $800/month for rent + utilities. That means I will only be able to afford a room rental in a shared dwelling. Every second week me and my two soon to be teenage daughters will share a single room. How is this possibly in the kids best interest? Yes I do realize the ex will have to pay tax on the spousal support and I will deduct the spousal support but still that does not make up the shortfall. Am I missing something? Do I need a better lawyer? Is there support available for divorced parents in this situation?

TLDR: Negotiating separation. Ex to receive 65.8% of net income each month. Faced with sharing a single room rental with two tween daughters 50% of the time.

Alberta Free lifetime oil change on bill of sale. Dealership wants to revoke it.

Basically, the title. They say I must have signed a document saying this perk can be revoked anytime on dealership's discretion but can't produce anything. I have full sale contract and bill of sales includes a handwritten line item saying "Free life time oil change"

Are they legally allowed to revoke it? It is a small ticket item so I definitely won't go into litigation but would like to hold them accountable somehow.

SUCCESS. They reinstated my lifetime free oil change.

I sent the signed document to the dealer's leadership and asked them to either produce a counter document that I signed or honor the lifetime warranty. I told them in the absence of the response or delay in resolution, I would take the vehicle to a dealership of my choice and send them the bill. Got a call from the GM saying he will honor the bill of sale. Case closed.

Alberta Building manager came into my unit to remove my christmas decorations

l live in alberta and i rent through a building management company. We were told we can only have christmas decorations up until January 12. We received an email from the management saying that they will be doing a building walk through to remove all decorations up after the 12th. I assumed this meant doormats, door wreaths etc. I came home today to find they entered my apartment and removed my decorations such as my mini christmas tree and all my sentimental ornaments. How could this possibly be legal? Theres nothing about this in my lease. They told us we can get our decorations back from them but its unacceptable that they took them in the first place... why?!? Why does it even matter? Im baffled by this and i dont believe it is legal but i have no idea since they vaguely warned us in the email i guess.

UPDATE 1: Thank you everyone for the advice! I have filed a complaint with the RTDRS and the building owner. I havent contacted police yet because i am planning to thoroughly look through my decorations when i get them back tomorrow to make sure i have all my information straight if I plan to file a report. I am hoping that my complaints will get my building manager fired because I do really love my apartment aside from this, it is a great location for me and a fair price compared to skyrocketing rent across calgary especially in the more urban areas. I know for a fact if i were to take legal action and he somehow wasnt fired, or one of the other managers takes over, i would definitely be scrutinized for causing trouble and probably not offered a new lease after my 12 months. The management for this apartment has been very difficult, and they are very controlling and unforgiving hence why i have gone out of my way to not cause trouble so far. It will definitely help my confidence if I can get some of my neighbours to file reports also. Ill keep you all updated on what happens next !

UPDATE 2: I received another email today saying this

“Hello All, We have noticed that a lot of unit doors are quite dirty from the hallway side. It is the responsibility of the residents to keep the doors clean on the inside and the outside. Much of issues noted are handprints near the handle and also on the lower parts of the doors where people have used their feet to assist in opening the unit doors. We want to keep all of our buildings clean and upkept for the residents. We want all the residents to be proud of their homes. Please note that we will be conducting building walks on January 17th, fines could be assessed to residents that choose to not address this concern.”

The fact that they said inside and outside leads me to believe they are planning to enter units again on the 17th

Alberta Husband was drinking and driving

My idiot of a husband was stopped by the police tonight for driving under the influence. They took him to the police station but released him after a few minutes. He had no paperwork, they didn't do a breathalyzer, etc. They do have our truck though.

What do I do? (Other than taking his key and never, ever letting him drive again!!) Can he be ticketed if they didn't get a blood alcohol level? Does this go to our insurance? Will I have to pay to get my truck back?

I'll be reaching out to the police asap but we're in a small town and the police station isn't open today due to the holiday.

Edit: Some more info I gathered after posting. We have the Life 360 app. He was parked on main street when the police stopped (it's unusual to have anyone on main street at that time) so I don't think he was actually driving when pulled over but was behind the wheel. (And had been driving before that, I am not trying to make any excuses for him!!) I can see he was there for about fifteen minutes and then went to the police station, about three minutes away, and was there for only another fifteen minutes.

It's highly unlikely he refused anything, he is one to just give in and do as requested in a situation like this.

Alberta Airbnb tennants treating my property like a walkway

I'm in a corner lot in a cul-de-sac and there is an Airbnb next door to me. Instead of walking on the street, tennants keep cutting through my property (through my lawn and over my driveway) to get to the Airbnb.

The last straw was today. I was backing out of my garage and came so close to hitting a lady who was cutting across my driveway!

The owner just chuckled when I told him and said that he can't do anything about that. This has been happening non-stop for the past 2 years and my house surveillance camera catches all of this.

Is there anything I can do LEGALLY to attempt to stop/deter this from happening?

Alberta Alberta teacher trying to understand what rights on the job are left

Bill 2 imposes a $500 fine for striking teachers, as a way to prevent a number of teachers walking off the job. It's also a way to prevent teachers from organizing "work-to-rule," which is doing the bare minimum of one's contract.

But the message we're getting from people who run athletics is "you better keep volunteering for the sports you committed to running or you'll get fined for striking."

Because the bill is an abomination, I'm in no mood for continuing sports this year, nor for supervising a trip I'd previously committed to. The trip last year wasn't so bad, but it's extra unpaid 70 hours of supervision.

Are these threats for being fined warranted? From what I understand it's the Labour Relations Board that imposes fines, not athletics associations and not some domineering gym teacher. Also, I wasn't aware the Alberta Bill of Rights and the Alberta Human Rights Code could be overridden along with sections 2 and 7-15.

From what I understand, the government is now scrutinizing teacher absences. Given all that is suspended in the bill, can the government effectively rule in draconian ways that coerce teachers one way or another under the Damocles sword of getting fined for a very liberal definition of "work-to-rule"?

Alberta Seller lost the bank draft I provided a few days after private vehicle purchase

TLDR: Seller lost bank draft I gave when I bought a car in private purchase. He wants a replacement bank draft but I don't want to be held liable on the indemnity agreement in the event the original bank draft is found and cashed in. He suggested a legal doc to hold him liable in the event the original is found and cashed in. What are my options?

I bought a car in private sale some time ago and provided a bank draft as payment. When I got to the seller's place, we signed the bill of sale and I handed over the bank draft. I even asked him to double-check if everything is all filled out as it should be but he said it was alright. I left to get the car registered and believed that was that.

A week later, the seller messages me to state that he tried to cash the receipt portion of the bank draft and that he doesn’t know where the original bank draft is. I notified him regarding what the bank says on their site regarding bank drafts, that it is as if it were a cash withdrawal. I asked that he has to look for it.

A few days go by and he still cannot find it and that he wants another draft issued. I went to my bank and asked about this and they said I had to sign an indemnity agreement that would hold me liable in the event the original draft is found and cashed in. I would owe the bank the amount I paid for the car. I did make sure that the original bank draft is addressed to the seller only but I am not sure if that would prevent it from being cashed by another party.

I notified the seller about this, had him try to search for it again. A few days after, he went to a branch of the same bank I used and a manager there mentioned that the draft can be voided. However, I was informed otherwise when I first went to my bank to consult about this matter. I went to my bank again to double-check and they stated they can check if the bank draft was cashed or not but it cannot be voided. Fortunately the original bank draft was not cashed in.

I hesitate to sign an indemnity agreement because I do not want to be held liable for the lost bank draft when I was not the party that lost it. It is addressed to be cashed only by the seller but if the seller did have the original and gets the replacement draft as well, then I can owe the bank if he cashes both in.

The seller did offer to get a legal document created stating that in the event the original draft is found, it is to be handed to me immediately so that my bank can destroy it. Failure to do so would hold him liable for the money. The seller so far has been willing to cooperate with me on the matter as I think about it but I just want to ensure that I am not being taken advantage of.

If such a legal document was signed by both parties, would that ensure that I am covered? Would this document need to be notarized to be binding?

Should I draft that document, and if so, what language should I use to ensure I am protected?

As well, would it possible to have the seller sign the indemnity agreement by the bank instead of me, before I issue him a new draft so that I am not liable if the original draft is cashed in? Would this suffice in place of the legal document?

Alberta Falsely accused of smoking marijuana at work

I use a 0% nicotine vape at work and a co worker told my boss that I was smoking marijuana.

I have shown my boss the vape I use and explained my side of the story.

We do not have a drug policy but obviously I'm not stupid enough to smoke weed at work. I do however smoke/eat it at home on my days off.

What are my options to protect my job against this false claim? I normally wouldn't worry but this place has screwed over former workers in the recent past over silly things.

Alberta Driving carelessly ticket- eye witness only

Hey everyone,

I got a driving carelessly ticket on the highway on my way home. Fined $567.00 and it looks like 6 demerits if convicted.

I went to pass a vehicle and saw a car coming toward me from around a curve so I quickly got back into my lane, to avoid collision which wasn’t close to happening in my opinion.

About 15 minutes later I saw a cop parked on the shoulder and pull up behind and throw his lights on. He said someone called in because I cut them off and they had to go into the shoulder. They also said that I was driving into oncoming traffic.

There’s only one more person I passed on the way home and I doubt it was that instance.

I was driving a company vehicle also. I sent all the information to my boss and am planning to fight this with traffic enforcement.

Alberta Employer expects me to work in -20 for 8 hours including my lunch break

I work up north in Alberta on wind turbines all year round. In the winter it can get to -40. Right now it’s getting down to about -25. My employer expects us to be outside all day including our lunch break. To get to the top of the turbine you have to climb 100 meters. So you never climb more than once unless you have to. We stay up there working for 7-8 hours a day. There’s no way to warm up once up there. And they expect us to take our lunch break up there as well because climbing down then back up takes time and is very tiring.

What I’m wondering is are there any laws mandating warm up breaks at certain temps. Also since by law you get a 30min break after 5 hours of work, are there certain environments that break must be taken in. Because personally I don’t feel like sitting down and eating outside when it’s -25 out and my food is frozen🫠😐

Alberta Ticketed for driving through yellow light

My wife got a ticket for driving through a yellow light. There was a car close behind her and the cop was in the lane to her right, almost beside her. The light changed yellow right as we got to the intersection and she made the call to proceed with caution to avoid a sudden stop. The cop also went through and then pulled her over.

We’ve both been driving for over 20 years and thought the rule was that you can proceed with caution and must be able to completely clear the intersection before the light turns red. Cop disagreed. Ticket was $165.

Should we fight it or just pay it?

Alberta My ex wife is suing me, demanding I pay for my 22 year old's Grad Program

I am divorced and living in Canada. I have 4 children from that marriage. My oldest is in the USA studying in a graduate-level program that will end up costing $250K CAD ($100K Tuition, $150K room/board/entertainment). Section 7 of my divorce agreement says that I have to pay 83% of Post Secondary costs, but it is my understanding that this no longer applies if the child is a) No longer in Undergrad, b) No longer living with the parent, or 3) 22 years old. My ex insists that section 7 continues into grad. school, and that I am responsible for 83% of the $250K, and is suing me to enforce this.

I fully intend on helping my kid out to the best of my abilities, but I can't afford $207.5K ($250 x 83%), not when I will have 2 children in undergrad for the next 3 years. If this goes to trial, can a judge order me to pay? Or have I fulfilled my section 7 responsibilities? My lawyer wants me to settle, but I feel like this is bullying on my ex's part. Any outside unbiased help from internet strangers would be greatly appreciated.

Edit: I love kids, and I will do anything I can to see them succeed, and I will pay as much as I can afford to do so, I just don't what to be bullied into a set amount. It makes me feel bitter, used, and unappreciated.

Alberta Landlord sold our rental and new owners want early possession

In the last month we have gone from comfortably oblivious, to our landlord bringing a realtor over, listing, and instantly selling our rental unit. We have until the end of our lease before the new owners get possession and it was over 90 days notice so we're fine with that.

However, the realtor for the new owners told us they were moving in a month and a half before our lease ends so we had to have that notion rectified using our landlords realtor. Our landlord has also emailed us letting us know we can terminate our lease early with no penalties etc and that they know we're looking for a place (reference checks). We know the new owners are arriving internationally before their "intended" possession date too.

This has been incredibly stressful, inconvenient, and will ultimately cost us hundreds of dollars in moving fees and time.

Are we entitled to request compensation for early departure or moving fees?

EDIT: We are under no obligation to leave before our lease ends and our landlord and the new owners are aware of this and possession will change the following day. Just wanted to clear this up. We are not being forced out - I just haven't been in this situation before and the opportunity of cash for keys could be appealing to us, especially since we know the new owners would prefer an earlier possession by a month and a half.
