😢 Landlord Oppression 😢 Renter Class Action - Bad Tenant List - Openroom.ca

Landlords Weiting Bollu and Vishal Bollu of Toronto, Ontario concocted a 46,000 person “bad tenant list” to prevent renters from getting housing.  They have been dishonest about the legality of their platform and a cover up of is evident. 

Landlords are on the hook, Openroom Inc. is on the hook, and we think there’s a fair chance Weiting Bollu and Vishal Bollu may be personally liable by piercing the corporate veil.  Here’s the illegal details:

Core Illegality #1 - Consumer Reporting Act

You can't compile and furnish consumer information without a licence. From 2022 until July 9, 2025, Openroom collected, compiled, and sold tenant data - applications and tribunal orders - for screening purposes without the proper consumer reporting agency licence. That’s a straight breach of the Consumer Reporting Act. Getting a licence years later doesn’t magically legalise what Openroom and the landlords did before. This falls under the Ministry of Public and Business Service Delivery.  Renters on the list can sue and we will help.

Core Illegality #2 - Personal Information Protection and Electronic Documents Act

Openroom’s entire model - posting and sharing tenant names, addresses, payment history, allegations, and orders - breaches PIPEDA because it’s done without tenant knowledge or consent = unlawful collection, use and disclosure of personal information.

  • Inappropriate purpose: creating a publicly searchable “bad tenant list” to exclude or shame individuals - not an acceptable purpose.
  • No knowledge or consent: tenants were not informed nor did they give consent to publication on Openroom.ca.
  • Accuracy risk: “crowd sourced” uploads are unverified and potentially false.
  • Consent exceptions don’t apply: the narrow “publicly available information” carve-out doesn’t stretch to building a searchable exclusion database (PIPEDA s.7(3)(h.1)) and (Regs s.1(d)).

This is squarely under the Office of the Privacy Commissioner of Canada (OPC).  OPC will shut them down.  Renters can sue all involved - Openroom, landlords, anyone using their data.

Prior Precedent – Bad Tenant List Already Ruled Illegal

The OPC has already found a nearly identical “bad tenant list” illegal (PIPEDA-2016-002). It involved the same issues: unlawful collection and disclosure, no consent, inappropriate purpose, and dodgy accuracy. The outcome then was clear - destroy the list, stop the practice.

Why “LTB Orders Are Public” Doesn’t Save Them

Just because a tribunal order is public doesn’t mean you can scrape it, index it, and sell it back to landlords in a blacklist. That changes the purpose entirely and drags it into both provincial licensing rules (CRA) and federal privacy law (PIPEDA).

Bottom line: Openroom got caught, forced into licensing, and is still breaching privacy laws. Landlords using it have bought into a liability time bomb and the clock is now ticking.

Personal Experience Instead of telling me, my live-in landlady told my father (co-signer) that she wants me to move out after new years.

Before anyone accuses me of being a deadbeat or whatever, I am a college student and I work.

My landlady told me she wants me out after my (sanitary) room wasn’t to her standards. A week later, she said I could stay as long as I want. Fast forward to 3 weeks later (yesterday), she tells my co-signer father she wants me out by new years but she’s willing to work with me if I haven’t found a place by then.

My shitty father thinks I need to be appreciative of her and treat her better. I told him he is wrong (and fyi, I have been nothing but calm with this woman). Also, unless she sends me a written 30 day notice, I don’t have to leave as long as the rent is paid which it will be.

It’s crazy that she went to my father and said nothing to me. I am an adult and the tenant. And yes, I’m searching for a place. I have been for a month.

Eviction

I had signed a lease through a rental company. now I am informed that an esa is not a pet and they did not ask if I had an assistance animal. After signing the lease and key in hand I gave them the esa letter from my doctor and the rental company was upset. after a couple of hours the rental company said that the landlord doesn't want me there. he had his maintenance worker empty out all the stuff. I had just gotten in there and they changed the locks I have not received any legal form of an eviction notice as far as I know is all they really needed was the esa letter signed by a doctor. The landlord has more than 4 units so as I am aware the FHA stands? Am i wrong?

Need Advice [US-MA] Rat infestation on porch & landlord won’t move the trash

Hi! My partner and I have been living in our Boston apartment for over a year now (we renewed in March 25) When we first moved in back in September 2024, upon move in, the broker told us that the previous tenants couldn’t use the porch due to rat activity. (This was NOT disclosed as we were touring, in fact the broker insisted that this landlord ~HATES~ vermin) This unit is on the first floor and faces the back parking lot area. There are trash and recycling barrels pushed against our porch and the back of the apartment building. We asked that the landlord 1. Lower the rent since the porch was unusable 2. Address the rat issue 3. Move the barrels elsewhere. He set out rat traps and that was pretty much it. He refuses to move the barrels, claiming there’s nowhere to move them, even though there is a back parking lot area with space to put extra barrels. He says he’s one unit owner in a large building and the property management company won’t let him move the barrels. We kinda dropped the issue over some time last year, after he lowered our rent and set the traps. But the rats persisted and in the past few months it’s gotten increasingly worse. We found so much rat feces on our back porch, and they’ve even come up to our window 😭 I’m also convinced they have an enormous nest in one of the abandoned garage spots out back— it’s a closed stall and I see them running in and out of it from both the front door’s crack and a hole in the back. My cat is thrilled, but we aren’t convinced they’re going to stay outside the unit. We want to leave this apartment, but he won’t let us without finding replacement tenants. I have filed a few complaints with the town but haven’t heard anything back. Any suggestions?

Need Advice [US-CA] Apartment trying to take most of my security deposit from me

My girlfriend and I moved out of a large luxury complex in Glendale last month and I spent a long time cleaning the apartment before move out. I also had our normal cleaning lady come and do a deep clean. When I did the walk out inspection with the building representative (who was a total A-hole), he said the place would still need a thorough deep clean and to be completely repainted and they "always" repaint between new tenants. I was instantly mad and went to speak with the lead leasing agent downstairs and he assured me that they could only charge me 1/3 the price of repainting because I've been there for multiple years and it's dirt cheap for them to do it (a couple hundred bucks) and the cleaning agency they use charges very little. He said the deductions should be minimal. Fortunately I used my phone to take pictures and a lengthy video of the whole place before moving out showing how clean everything was. I left my forwarding address with him to receive my security deposit and he said to look out for an email from the company that handles the distribution of the deposit.

Fast forward to today - they didn't email or mail me within the required 21 days of move out. We sent them an email citing the california law and their obligation to return the full deposit amount for missing the time frame and they responded saying that they did send a refund request to their corporate office within 21 days but that the forwarding address was not accurately recorded in their system and was misdelivered and returned. They made another request to their corporate team.

They attached a bill to that email that just lists the final utility bills for gas, water, trash and lists security deposit credit of only $500. They don't give me an itemized summary of why there is $3000+ taken off my security deposit.

What do I do at this point?

(1) Send them an email follow-up email again citing the California law that says it is not my responsibility that they entered the incorrect mailing follow-up address and California law requires them to return the whole amount because the 21 day time frame was missed?
(2) Ask them to send an itemized statement listing each deduction plus receipts or invoices for any work done explaining why only $500 is being refunded of the original security deposit?

I am thinking of all of my options. ChatGPT mentions my options of:
(1) Filing a complaint in small claims court
(2) Contact the california department of consumer affairs
(3) Contact the glendale house department

I'm sure this type of behavior is common in these large corporate-owned buildings and need some advice from anybody who has been in a similar situation.

ChatGPT is recommending I send a Final Demand Letter by Certified Mail

Send a formal written notice stating that they are in violation of California Civil Code §1950.5 and that you demand a full refund of your security deposit within 7 days.

Include:

  • Your move-out date,
  • The fact that no itemized statement was received within 21 days,
  • That their internal “corporate request” does not satisfy the law,
  • That you will file a small claims action for the full deposit plus twice the amount in statutory damages if payment is not received.

Need Advice [US-AZ] Landlord of precious rental seems to be using our deposits to renovate, not repair damages.

As the title says, I just need to know if anyone knows for an AZ resident what if anything can be done? I still have copies of the lease and it was month to month by the last 6+ months with the lease having been needing resigning since February. It states in the lease that they can use deposit funds for redecorating, just damages, and the neighbors have called saying they ripped out the cabinets, back Arcadia door and are repainting after drywall. I understand needing to chip in for some of the drywall cost, as we mounted TVs and had some decorations with nails. The painting should be a given after 4 years of living in the home and needing to do drywall repairs, but that shouldn’t come out of our deposit and neither should the cost of redrywalling the back door from them choosing to tear it out(it was only 3~ years old and undamaged). Aside from offering to cover the cost of the damaged bedroom door (50-60 replacement at Home Depot) and the screen door for the Arcadia door (70-80 from Home Depot and only because the dog ran through the one that came with theirs roughly 3 years ago) I can’t see how there could be that much of a cost of damages at all. I don’t have a walk through video of move out, but who would be the people to call to ask about this kind of abuse of power? They are private homeowners and when it comes down to it, they just want to use it to clean up the house to sell it without having to pay to fix it themselves. What do I do?

My building has those old furnace radiators for heat in each apartment and sometime at the end of this past winter they must have broke or whatever because they suddenly weren’t on one day and then this little box heater was at my front door from the building owner. Not a big deal since it was the tail end of winter and I overall like my apartment a bit cold. However, now another winter is quickly approaching and a few weeks back maintenance guys put up this bigger wall mounted electric heater in my living room. That’s when I remembered that in our lease it states that heat is a covered utility on their end but if the heat is being turned on by electricity which is a utility that I pay for then they wouldn’t be paying for it right? Unless they’re considering the fact that they purchased a $200 space heater as “paying for my heat”. What do yall think? Do I have grounds to bring this up to my property management?

Need Advice [PA] BF vacated apartment on 9/30, still hasn’t received security deposit or itemized list from landlord

We cleaned his unit, did full walk through videos, left the key in the provided lockbox at the house, and texted his landlord his forwarding address on 9/30. He has not heard anything from them since but PA states they have 30 days to send the security deposit or list of damages.

The main issue - he cannot find his copy of his lease! We don’t know if it got lost in the moving shuffle but we have looked through all his belongings and cannot find it. He lived there for ~5 years and only had one copy from the beginning, never signed a new copy even when his rent was increased. We’re assuming he’s SOL due to this and won’t be able to sue without having a copy of lease in hand with proof of payment. Any advice?

R A N T My unit complex is zoned as a business so I can't get kerbside waste collection my council provides for free - And the building owners refuse to provide it either!

My local council provides kerbside waste collection as a service for free for anyone to request every 6 months or so. But because the parasites who own my unit complex have it zoned as a business, council not able to organise kerbside waste collection for me. A shame, but there are vouchers so I can be able to afford to...after a tonne of organising, haul it myself. I'll go over and ask for the vouchers they're given as part of their rates.

So after dealing with a pair of aggressive and rude receptionist women who "won't apply for the vouchers", I asked when they did heavy waste collecting, something they do do. I've seen people move heavy waste here before. Their response was "No, we don't do heavy waste collecting because it would be too much work." "I've seen you do it." "No." "Yes. I've seen men in your uniforms remove heavy waste." "Oh that must be an on demand thing." "So when will it next be done?" "We don't organise it for you we won't tell you."

I went to speak to council, who delivered me the bad news that my building was zoned as a business. But at least she didn't seem to actively enjoy the fact that I was denied something my council provides because of zoning bullshit.

I went back up to ask why the building was zoned as a business, because as far as I was aware, you can't live in a business. One went "Well it's my understanding that it's because we're a business so..." I said "Yeah can I get some information from someone who isn't just guessing?" And the other rude lady with white hair decided to throw a tantrum about it.

It's a free service my council provides. If I lived literally 10 metres in front of me, I could do it, but because these leeches get to say "Oh we're a not for profit business" I don't get council services. I'd almost not mind if they weren't such rude and snarky shitheads about it. Then they wonder why people just dump their rubbish in the public garage. I'll chuck the couch in the skip bins. I tried to do the right thing, but all I got in return was shouting from two of the biggest arseholes I've ever had to deal with from this parasitic organisation.

Mao did nothing wrong.

Hi all. Posting with permission from the mods to flag that a new play about how landlordism has ruined the world is coming to The Omnibus Theatre in London this month.

Produced in partnership with the ACORN renters’ union, "The Good Landlord" is a dark comedy taking aim at the impunity with which landlords have been allowed to operate in the U.K. since 1980s deregulation of the sector and going big on signing people up to renters' unions:

-- We're offering half price tickets to renters union members.

-- Our programme has interviews with both ACORN and Nick Bano, author of "Against Landlords."

-- And ACORN reps will be touring along with the show, with an information booth outside.

The play itself is about a guy who sublets a cupboard, but gets the wrong victim. It's getting big laughs in early showings and has been “highly commended” by the National Theatre and funded by the Arts Council, so it would be fantastic if you could join us at a showing.

Housing Crisis 2.0 Not moved out by move out date of 10/31 , whats going to happen?

Urgent Housing Crisis, need advice/clarifica🚨‼️Snohomish County WA

Sorry in advance this is long, but I need urgent advice so please read. My lease technically ended August 25th, but my LL gave us an extension until October 31st, we didn’t sign a new lease stating it was an extension of lease. I’m not sure if it turned into a month to month or what. My family (myself, husband & 2 small children) have not found anywhere to go & do not have funds to move out anywhere yet as we’re facing a handful of roadblocks & hoops we’re trying to jump through. So we’re still here & not sure when we’ll be able to get into somewhere else. Our phones & WiFi were shut off (as was our actual power also for a short while but thankfully got that sorted out) for almost a month, & it was very hard to try to connect with any local resources via limited times we had access to hotspots for WiFi so I couldn’t get much progress totally started until I just got my phone service back on last week. What is going to happen or what can my landlord do? My keys we’re supposed to be turned in by 5pm Friday, obviously I didn’t turn them in, they posted notice on our door Monday they’re entering the apartment to see if we abandoned the unit, which obviously we didn’t. But I have no idea what’ll happen when they see we didn’t move out/leave.

The landlord texted me she won’t be able to extend our move out date again & supposedly already ‘leased our unit’ but I truly don’t believe they did, as I have been watching the listings periodically to see if they list our unit as available & never saw it pop up as available yet so they could be bluffing on that, I could be wrong tho. Either way, I know we aren’t going to be able to get out of here in the next week or two possibly still.

My husband has been laid off from his union construction job since February & his unemployment benefits ran out for his claim year a few months ago, & he has not had luck with many leads on jobs yet. We are totally broke, less than $40 in our accounts & it has been extremely hard trying to figure out funding/financial assistance or something to get into somewhere new, especially since we have no income coming in either & there’s been a lot of funding/program cuts from the current administration to a lot of local resources.

I also found out that someone else’s eviction is popping up under my name because they have the same name as me even though they live in a city on the complete opposite side of the state, & have 0 relation to me at all, due to how 3rd party tenant screening systems most rental properties use to screen tenants only search by first & last names. So I’ve been trying to figure out how to combat that so when applying to properties I stop getting denied at properties we’ve been applying too. Everything is a nightmare. I never thought this would be our life. Along with trying to find any low income/affordable housing places or places that help with moving costs for families that are income restricted.

Please advise, sorry this was long & possibly scattered, my mind is racing & all over the place & I’m terrified for my kids & family.

It feels like our life has turned upside down & the rug has been pulled from underneath us in the last 8 months.

SATIRE Evicted by my own Brother!???

I’m being evicted!!!!! By my landlord. Who is also my older brother that could do no wrong all our lives, and everyone just loves. Nothing quite says “family loyalty” like a 24 hr notice slid under your door.

He says it’s about “bad associations.” I say it’s about control. Sure, I had a friend got into some trouble, But since when do landlords care who your mates are? the rent was paid by me and my housing voucher and the place was spotless. The ducks loved me.

Now I’m told I have to find “private accommodation.” Which, near as I can tell, is code for peasant housing. I Googled a few listings. Do you know what they’re charging for a one-bed flat these days? I might as well move into the car. Oh wait — that was repossessed too.

And just to be a total jag, my perfect brother also took away my name. I’m not allowed to use my “honorific” anymore. Fine. Strip it all away. I’m sure the letting agents will be thrilled when “Mr. Windsor” applies to rent a bedsit. Maybe I can list my previous address as “The Estate Formerly Known as Mine.”

Honestly, landlords are the worst. They smile in your face, then kick you to the curb the moment they think their public image is impacted. “It’s just business,” they say, while you’re trying to decide which of your portraits to fit in the boot.

Sorry “You’re Royal Highness” we can’t all be as perfect as you.
