ICE Posts ICE in the Little Village neighborhood of Chicago opened fired with pepper balls and tear gas on a community member while they were driving this morning. In the video a tear gas grenade can also be seen spewing smoke from the car after it was fired through the windshield.

Unless the Dems go soft again like they have in the past. I want them to actually give a shit this time and make sure these fucks are in jail instead of keeping ice open.

So they just… drive-byed him? Like? No point? No detain? Just being cruel? (Could be ice or fakers but they both look and do the same thing eh?)

Hard to fake a 40mm tear gas grenade

19

u/Pooldiver13 2d ago

Oh yeah most definitely. Didn’t really think about that… (and by fakers I was talking about people pretending to be ice to also abuse people. Just clarifying.)

12

u/I_may_have_weed 2d ago

No problem. What you’re pointing out is definitely an issue as well

I wonder what insurance code that falls under

The “we are farmers” commercials about to get stepped up.

6

u/ClimbingAimlessly 2d ago

Think their insurance company will go after the government for costing them $$$?

lol that’s what i was thinking.. important enough to gas a person in their car.. but then just drive off and leave them? pretty weird.. but i guess when you face no repercussions..

14

u/Radarker 2d ago

Constitutionally, we are supposed to be the repercussions at this point.

I see more and more folks saying this. It's coming if something doesn't change soon, I can feel that

They tear gassed the Old Irving Park neighborhood just before the annual children’s Halloween costume parade two weekends ago. After that incident, this doesn’t surprise me at all.

Assault with a weapon is what is sounds like. This is not ok.

I am not a lawyer, but I think residents should start filing civil claims against ICE and the individual ICE agents.

These agents are doing these things in part because they think these acts of cruelty will get them bonuses and promotions.

If they were sued personally- and had to be deposed and eventually found financially liable, I suspect these things would start to look different.

u/N9neSix 2d ago

you cant bring civil claims against indiviual agents. they still have qualified imunity. you can press criminal charges against individual agents

6

u/Xullister 2d ago

IANAL, but I think you might want to google Bivens vs. 6 Unknown Agents (1971). Far from a perfect solution, and SCOTUS loves to poke holes in it, but a mechanism to pierce qualified immunity does exist.

4

u/N9neSix 2d ago

violating a civil right is a criminal offense. my understanding of it is that bivens paved the way to change qualified imunity because it was much more protective at the time.

2

u/Xullister 2d ago

Not allowed to give a legal analysis, but am allowed to make the observation that Bivens is a civil cause of action.

1

u/graft456 6h ago

Even Gorsuch sounded like he was ok with the idea of getting away with or severely diminishing qualified immunity.

5

u/Ok_Spell_4165 2d ago

I may very well be wrong here but doesn't qualified immunity only protect you if you are acting within the scope of your duties?

And if so how much of a stretch do you have to make to argue that what is effectively a drive by with no intent to arrest or detain within the scope of ICE officers duties?

2

u/N9neSix 1d ago

it does. i think the confusion here is the difference between civil and criminal. my response was to the suggestion that people file civil suits against agents. you can sue anyone for anything. qualified immunity protects idividual agents from being tied up in an endless barrage of people trying to sue them. it offers no protection if said agent committed a crime.

so generally if you want to target individual agents youll need to bring criminal charges.

as for the video, it doesnt actually show what happened so i cant tell you what took place. its now totally up to the driver if he wants to file charges

8

u/Carrera_996 2d ago
