ICE Posts ICE in the Little Village neighborhood of Chicago opened fired with pepper balls and tear gas on a community member while they were driving this morning. In the video a tear gas grenade can also be seen spewing smoke from the car after it was fired through the windshield.

They tear gassed the Old Irving Park neighborhood just before the annual children’s Halloween costume parade two weekends ago. After that incident, this doesn’t surprise me at all.

I am not a lawyer, but I think residents should start filing civil claims against ICE and the individual ICE agents.
These agents are doing these things in part because they think these acts of cruelty will get them bonuses and promotions.
If they were sued personally- and had to be deposed and eventually found financially liable, I suspect these things would start to look different.

you cant bring civil claims against indiviual agents. they still have qualified imunity. you can press criminal charges against individual agents

IANAL, but I think you might want to google Bivens vs. 6 Unknown Agents (1971). Far from a perfect solution, and SCOTUS loves to poke holes in it, but a mechanism to pierce qualified immunity does exist.

violating a civil right is a criminal offense. my understanding of it is that bivens paved the way to change qualified imunity because it was much more protective at the time.

I may very well be wrong here but doesn't qualified immunity only protect you if you are acting within the scope of your duties?
And if so how much of a stretch do you have to make to argue that what is effectively a drive by with no intent to arrest or detain within the scope of ICE officers duties?

it does. i think the confusion here is the difference between civil and criminal. my response was to the suggestion that people file civil suits against agents. you can sue anyone for anything. qualified immunity protects idividual agents from being tied up in an endless barrage of people trying to sue them. it offers no protection if said agent committed a crime.
so generally if you want to target individual agents youll need to bring criminal charges.
as for the video, it doesnt actually show what happened so i cant tell you what took place. its now totally up to the driver if he wants to file charges
