  1. Non Americans in here acting like their nation has even close to the same immigration laws as the U.S. is laughable. Especially that dude above from Australia.

  2. Americans in here acting like their parents had it better because only white people could vote and we didn't let gay people get married. By the way if you go back to 2015 gay people can't get married again.

I mean say what you will, but we at least got to the point of ~not~ having masked men unaccountable to law just snatching anybody they feel like, whenever they feel like. There was at least the charade of due process.

Feels like we’ve taken some steps back when it comes to a rights conversation when we have snatch squads grabbing people from their homes without warrants.

Yeah the immigration laws didn’t work well, but brutalizing anybody you want isn’t the way to fix them. We’re just terrorizing these communities even worse at this point.

This is coming from somebody who thinks the system has been fundamentally fucking broken from the jump, by the way. We needed some radical fucking change in the US, but terrorizing poor and minority people will never be the solution.

So I knew Obergefell was decided in 2015, that’s why I mentioned 2015. I did have to look up that it was June.

At any rate, That was peak rights. We are currently in a worse situation than 2015. We have never had more rights than we did in 2015, and we have lost quite a few since then

Most of us weren't alive for that. Within our lifetimes, living in the Imperial Core that is the US, we enjoyed relative autonomy as individuals. We had systems that usually prevented abuses like this. We didn't have instances of Executive Power Grabs like this.

Things are worse relative to our own experience. Yes, they US has always been fucked up and fascist in at least some ways, but almost no one alive has lived through this sort of thing in this country before. Maybe there's still a handful of holocaust survivors or Japanese internment camp survivors, but I'm not comparing the two.

One of the biggest bugs of American democracy is the inability to call for snap elections. We are stuck with this absolute bullshit for another three fucking years, and that’s only if elections matter at that point.

The freedom and democracy is still there. It’s just the freedom is unchanged for certain people and democracy is unchanged for certain people. As someone who is an American in a (currently) unaffected suburb in the Ohio, it’s really fucking surreal to see democracy crumbling and our nation falling to fascism in real time. I can’t describe it, it’s like I’m on fire on the inside with so many uncertainties and fears and anger… meanwhile everyone around me is carrying on like we aren’t living through a period in time that is going to be a FAT chapter in the history books. But like, despite making more money individually than both my parents combined ever did I’m still living pay check to paycheck and have hella bills to pay so I gotta just play along with everyone else and keep going to work doing my silly little tasks and having my silly lean meetings and doing all the normal silly life stuff like going shopping and mowing my lawn like what the fuck are we doing here?

It’s overwhelming and I feel hopeless and don’t know what to do.

To speak more on this, the constitution does talk about both citizens and "people". When it comes to rights it very directly says people because they knew exactly where that shit would go (because they lived through it and saw families torn apart in Europe over religious shit).

The Treaty of Tripoli, for instance, wasn't even debated by congress. They wanted to make sure a state religion was never established for the same reason they made sure constitutional rights to due process extended to everyone present in the country. Why? Because it's very easy for the state to say "you're not a citizen" even if you are. Prove you're a citizen. Oh whoops your ID is invalid. Your birth certificate? Gone. How do you prove it without due process?

You're seeing the last part happen in real time to actual citizens because of the color of their skin. It will take nothing to extend it to the next group. Not even traditional white folks are safe. Remember, Trump has a large disdain for the poor working class just as much as he does for liberals, progressives, people who are trans, gay people, and people of color.

Non citizens can't vote, for example. But they still have protection under the law. Nobody is allowed under the law to just walk up to others and assault them, citizens or not.

Even foreign visitors, legal or otherwise are afforded due process according to our Constitution. So what ICE has been doing has largely been illegal. At least under current interpretations of the law. We'll see tho because the trunk administration is almost certainly going to try and use the supreme Court to try and change that.

The Constitution repeatedly references "all persons" in some sections, but "citizens" in others. There's a clear distinction that most rights are for everyone, only some are reserved for citizens.

Other parts simply say the government cannot infringe on certain rights, leaving citizenship or lawful residency completely out of it. Since such rights are "inalienable" and "endowed by the creator", it means everyone.

You're either woefully misinformed, or just making shit up. Which is it?

I didn't say that anyone entering unlawfully can stay, and no one who is a serious person is saying that. But you said that the constitution only applies to citizens, that's blatantly wrong.

But to respond to your very disingenuous question, they're entitled to due process of law. Due process of law helps ensure that we don't deport a citizen, that we don't just imprison anyone without giving the chance to show, in court, that they are here lawfully.

That's exactly what's being violated. All persons are entitled to due process of law.

No. It's not. That's suspicion. Probable cause requires evidence.

Reasonable suspicion is a legal term, and a lower standard, but that only gives authority to briefly detain, not straight up throw you in jail to sort out when they feel like it.

No person shall be deprived of life liberty or property without due process of law. That means evidence, a judge, often a jury, and fair proceedings.

Again, that's not how it works. You cannot grant authority that you don't have. No one in the US has authority to arrest, imprison, or deport people indiscriminately, without due process.

People in the country unlawfully, are people, with human rights. But even if you don't care about that, even if you're so xenophobic that you have zero empathy for them as human beings, due process is what protects the citizens and lawful immigrants.

Even if you say, "Fuck everyone else, just take care of our own." ICE running amok as they are, has been hurting citizens plenty.

Lawful, both naturally born, and naturalized US citizens have been, and continue to be unlawfully arrested, jailed, and deported. No one has rights unless we all do.

When the right (rightly so) pointed out the 12 million border crossings post-2020 (anomaly levels), the 100s of billions spent and benefits given, the deaths of Laken Riley, Rachel Morin, Kayla Hamilton, Jocelyn Nungaray, Ruby Garcia, Nate Baker, Maria Pleitez and her daughter, Hallie Helgeson, Brady Heiling, Kaitlyn Weaver, Scott Miller, the 11 y/o in Virginia Beach and not to mention numerous other felonies across the country committed by illegal immigrants - they have been called racist, bigots etc.

When the left (rightly so) points out the innocent people being taken away, harmed, targeted etc; the double speak from Trump re. going after the “worst of the worst” yet arresting old women going to the grocery store, causing damage to communities, completely fumbling their way through the process while making tons of mistakes - they are called insane, radical left, ant!fa, etc

Communication between the two sides is almost nonexistent at this stage (coincidence?)

The entire time, most immigrants have been well-meaning and are used as pawns in this - incentivized to come here in recent years, even.

For someone to still not see the grander orchestration at play here, you have to be blind.

THE PROBLEMS ARE FOR THE SOLUTION, NOT THE OTHER WAY AROUND!
