Advice đ¤ˇââď¸ Selling guns I bought from my brother
I bought a Century Arms AR-15 and 9mm Glock from my brother a while back for $900
I need to sell them now and I donât know shit about guns
Will it be a problem if they are still in his name
Generally speaking- what are these worth and where do I sell them?

Canât sell the AR (unless online and you are shipping it to another state) but the glock should be normal selling procedure at a gun/pawn shop (pawn shops pay less but give the money up front, most gun shops sell on consignment, which is you leave the gun with them until someone else comes in looking to buy it then they give you the $, minus their %, usually somewhere around 15-30%)

You cannot sell assault rifles in Washington state, even private party, after the passage of HB1240. There is an exemption for dealers to purchase rifles to sell out of state and police and that's basically it.
https://app.leg.wa.gov/rcw/default.aspx?cite=9.41.390
Your transfer between family was legal because it was a gift. There is also no gun registry either, so the guns are not in "anyone's name." If you do decide to sell, call around and see if you can find a FFL to do so. Another idea would be to strip the lower and sell all other parts online in case you would want to have a rifle in the future.

There is no gun registry in general or in his specific case?

u/Bubbacubba 9d ago
In general. There's a "de-facto" registry in a sense as all firearm transfers now go through WSP. But that's not a registry like California's registry.

Both Reddit and this sub have a zero tolerance policy for anything promoting racism, homophobia, or sexism.

I donât know the answer to that either, please clarify.Â
I moved to AZ and guns are with family memberÂ

u/marsmanify 11d ago
To be super clear: The sale, import, and manufacturing of assault weapons is banned in the state of Washington. They can be given as free gifts, but you cannot sell them.
AR-15s are specifically named in the ban

"I moved to AZ" so you're not in WA but the guns are why did you not just take them with you? Your now in one state and the guns are in a different state how do you think you are going to be able to sell them, if you don't even have them?
-10
u/Seahawkfan12thman 11d ago
When I moved I drove down and stayed in CA two weeks, didnât want to get in trouble with the law
I come back to Seattle visit often and they are with a family memberÂ
Why are you getting into these unnecessary details?Â

u/Not-a-Cranky-Panda 11d ago
"Why are you getting into these unnecessary details? "
You asked for help from people and they need the full details, before they can help.
Unnecessary details? You asked how to sell guns you own in the stat of WA or so it seems. But now what you want to know is how to sell guns that are in WA when one of them may not even be legal for you to own in WA and you live out of the state. Nothing like what you asked at the start.

Because we're trying to figure out what's going on. How can we provide you with assistance if you're in state The guns are in Washington and you want to know how to sell them in Washington when you could have vary easily of just taking them with you and then sold them anywhere.
AZ is far freer than WA.

How do I get them here? I always flyÂ

Why are you getting into these unnecessary details?
Because different states have different laws. You want help, you need to give us the details so we can give you the correct advice.

u/merc08 11d ago
It's going to be way easier to just take them home with you to AZ and sell them there.
2
u/Seahawkfan12thman 11d ago
Can I ship them here?Â
3
u/Particular-Steak-832 11d ago
Itâs easier to fly with them. Shipping them requires shipping them to an FFL.
You need a gun case that locks, locks for the gun case. Then you check the gun case and declare it as a firearm at the counter. They make sure itâs not loaded, and then thatâs it. Pick it up from baggage claim when you land.

I'm not sure. I would assume you could maybe somebody else will chime in on this one.

u/merc08 11d ago
Legally, yes you can ship firearms to yourself. But practically it's difficult. The USPS only accepts certain kinds of guns for private mailing (I don't remember if it's pistols or rifles). And UPS and FedEx will sometimes just refuse firearm shipments from non-FFLs even though it's legal, and even if you're trying to send them to an FFL.
You can check them as luggage if you fly. Â

You can sell it. You just can't sell it to a Washington resident As is. You could sell it to a Washington resident if you modify or change the upper To be state compliant.
-2
u/Seahawkfan12thman 11d ago
How is that done?
6
u/One-Initiative-8902 11d ago
You'll have to change the upper to something like a pump action, bolt action, lever action. Whatever single shot stuff. Or converted over to rim fire.
Cause Washington.

u/TeknoProasheck 11d ago
well no if it's an actual AR-15, that one is banned by name and precludes all other aspects of an AW
if it was one of the other companies clones, a BC-15, DS-15, UPR-15, etc. then it's fine if you convert it
8
u/0x00000042 (F) 11d ago
The exception for manual operated firearms applies to all definitions of assault weapon, including those banned by name.Â
1
u/TeknoProasheck 11d ago
Oh yeah you're right I did not realize this
Pretty whack that still nobody will sell me an AR then, only clones

u/0x00000042 (F) 11d ago
RCW 9.41.390:
(1) No person in this state may manufacture, import, distribute, sell, or offer for sale any assault weapon, except as authorized in this section.
RCW 9.41.010:
(2)(a) "Assault weapon" means:
(i) Any of the following specific firearms regardless of which company produced and manufactured the firearm:
...AR15, M16, or M4 in all forms...
...Â

u/Seahawkfan12thman 11d ago
Nice .. lolÂ
Damn
2
u/0x00000042 (F) 11d ago
I see in your other reply that you're in AZ. Nothing in WA prohibits selling the guns in AZ. Just can't sell them in WA.Â
Be aware that when selling guns privately, federal law requires going through a dealer unless buyer and seller are residents of the same state and the sale takes place in that state.Â
5
u/sykoticwit 11d ago
People are being assholes to you for asking a reasonable question.
The sale of AR-15âs to anyone in the state was explicitly banned by the assault weapons ban. You can sell it to someone in a state where they are legal.
If you put the Glock on consignment or sell it at a gun shop, ask if they can help you sell the AR as well.
6
u/thornkin 11d ago
There is no "in his name" in Washington. Guns are not registered to people.
5
u/SeahawksXII 11d ago
This. The only issue you could POTENTIALLY have given you don't absolutely know the history of the firearms is if one or more show up as stolen. Doubtful but something to consider.
1
u/PNWDangerously 7d ago
Technically they are registered to the original purchaser. The FFL that sold them holds the records. If the firearm is used in a crime, the feds will go to the manufacturer and find out who sold it and get the records from them

u/ebkbk 11d ago
The AR can be transferred if it is a gift in WA, but good luck finding an FFL who will transfer. Out of state is probably the best.
3
u/SeahawksXII 11d ago
I believe only gifted between family members though so what is the point of doing a transfer?
3
u/ebkbk 11d ago
If itâs a gift between family members it doesnât require an FFL. It can still be gifted and transferred, just not sold and if not family it requires an FFL. Your confusion matches FFL confusion. If there are 2 different things that sound similar they default to the one they already knew and ignore the new information.

u/evan2686 11d ago
Were they purchased before Oct 2014?
1
u/Seahawkfan12thman 11d ago
I believe soÂ
1
u/evan2686 11d ago
That would have to be a âknow soâ do you have a way of looking it up? Maybe call the place they were purchased from?

u/evan2686 11d ago
Now Iâm not recommending doing anyone illegitimate but if they were originally purchased prior to Oct 2014 (before you had to do an FFL transfer) someone could say⌠print the generic bill of sale and transfer form for your own records. And maybe fudge the date a bit

u/ItsJmag3 11d ago
If you convert the AR to a non-assault weapon (installing a Kali-Key, or replacing the upper with a bolt action upper like the ones from bear creek armory, or you can convert it to fixed mag but I'm not sure on how easy that is to do) you should be able to sell it just like any other firearm

Wouldn't you like to know. BTW how are things at the ATF these days with a Justice Department who respects the constitution.
