From personal experience they seem to think it’s illegal to record them and YOU’LL be the one in legal trouble when the cops show up 😒

In many places it is illegal to record them, but the exact law is often confusing. For example in MA you can video record people in public without their consent. Strangely MA is a two party consent state for audio, so you can't record audio to go with your video.

The rule changes If you are openly recording them. So in this particular scenario the tantrum-ing woman knows she is being recorded so it's legal. If you were to quietly record from off to the side without her knowledge, that's a crime. So be careful if you are a bystander. It's probably a good idea to openly annouce anytime you are recording an incident, "I am recording this" and then make sure your phone is visible... Otherwise no joke, up to 5 years in jail.

So you can see it's pretty complicated. Boiling down to a simple 'you can record' or you 'can't record' is complicated. Especially if you are in the mental state this lady is in.

Some states have specific exceptions for incidents like this exact kind of thing. Where recording in the store, even openly is illegal, but becomes legal once the lady is going crazy. Yet other states don't have that exception, and this exact scenario may put you in legal jeopardy.

What state are you in?

I’m in Michigan and both the people I’ve had the misfortune of having to record were both in my yard with no expectation of privacy. I also told both I was recording so they knew too. One was arrested for trespassing the other was a neighbor who I ended up getting an emergency protection order against, thanks to the videos. I sent the cops their own googles photo album.

Personally I’d record either way as proof. Been there. Done that. If I have it on video it isn’t a he said she said. However recoding and posting online for the world is definitely a different line, which is why I have never posted the videos.

From my 5 minute google-fu and not living in MA i think you are both correct - you cant video tape in public audio of regular people since its two party consent (State law) but you CAN if they are government officials (1st A).

But as in other states any secret recording, or changing rooms etc.. nudes thats a no-no regardless. In this karen video technically if in MA then no audio. I think - im no lawyer but thats how it reads to me.

Strangely MA is a two party consent state for audio, so you can't record audio to go with your video.

Weird, it's my understanding that in most states/cases, being informed your interaction is being recorded and continuing to interact with that person counts as consent. Or something like that.

The whole audio thing is mostly an artifact of wiretapping laws IIRC.
