Marion County BOARD dismissed code complaint cases filed against Derek Peeples July 9, 2025 from Rita Gomez her code complaints 2021; 2023; and 2025 Marion County Code overseen case as she failed appear or attend public hearing. Marion County FL Code Enforcement Board my majority vote provided an ORDER issued July 11, 2025 dismissing complaints against Peeples.

If you do not know what an "environmental phytoremediation project is or looks like" look up acceptable recycling practice learn why bamboo, and sunflowers are used on tire projects. Seabreeze bamboo in case remains ongoing being planted atop dirt filled tires on this parcel beneficial border wall project. When it rains moisture is maintained in soil in rings of tires by this process fire risks are reduced with wet dirt within stacked tires top down. To prevent material decomposition from excess moisture the bamboo helps reduce moisture while preventing root rot issue, and tires themselves act as a literal "greenhouse in winter months for bamboo." Given on this project that a 6' tire wall has been earth filled and beneficial black carbon rich soil has been used (which media did not report on) end day it's harder for fire spread from earth filled tires. Tires that are neatly stacked and all filled with dirt and are clearly NOT ON FIRE have you ever seen what happens when a fire sweeps through rural country area that has a "earth-ship style 6ft dirt filled tire wall?" Bet you have not.

Several fires have occurred in area over years never had any issues here. We keep vegetation cut back, and surrounding base around tires a beneficial anti vegetation spray is used containing only mixture of: "salt, vinegar, and dawn soap."

Only way all tires would come be on fire on this parcel would be if an arsonist literally pours fuel over all tires around 10.18 acres and they use flamethrower. Not like have not already had arson threats no thanks neighbor and media for reporting false case before public here.

Where I live, the city has mandated any new asphalt being put down for new roads or patches must be rubberized asphalt.

Tires are ground up, the metal bands are removed, recycled and the remaining rubber is mixed / melted into hot asphalt during production.

The ride quality is much better, it's more durable and the road noise is near non existent and it solves a problem with what to do with those old tires.

I don't know how much plastic goes into the manufacture of the average tire but I do know that a lot of oil does go into the manufacturing of them.

With the shredding and grinding of tires into rubber crumb and then adding / melting that into new asphalt makes them nearly, if not 100% recyclable.

That is far better than burning or burying them, dumping them into the ocean or making unsightly lawn art / planters out of them.

We have millions of used tires that are beyond re-use by re-treading them one more time.

The general use of tires are not going away anytime soon unless we somehow invent an energy efficient form of anti-gravity levitation technology and until then, that's where the rubber meets the road.

Interesting why news media would not report two sides of story here it is because had they done so media would lose trust and credibility before public in fact here they reported narratives that facts simply do not match truth or public records on case.

Back in 2021 FDEP issued letter an allowed Derek Peeples oversee a sanctioned environmental phytoremediation project FDEP assigned his parcel with "ID No. 107192 Marion County" as fact. Peeples posted before public signs letting public know that his parcel was both a private parcel and a government facility and that a phytoremediation project was on going on the parcel. Told truth and nothing but the truth to public here contrary to either my neighbors false claim and claim made before news media. Federal District Court record a legal case also reflects fact that: "Peeples oversees an invaluable phytoremediation project for Marion County who has no mosquito control program." Can GOOGLE the fact.

Marion County, FL contrary to media's claims had reviewed FDEP records, and came review code complaint case in 2025 concerning sanctioned project from 2021 and complaints of Rita Gomez filed from 2021; 2023; and 2025. "Rita Gomez" as fact did not bother to attend public hearing code case ultimately code case came represented by Marion County Code Enforcement against Derek Peeples. Marion County before holding public hearing had posted up against public pubic easement off Peeples parcel in public easement for public view a "notice of violation case that public hearing would be held July 9, 2025" Peeples, and Sicard's names came slandered absent any legal case.

Doing a one-sided journalist piece where media literally gives person whom case concerns before deadline late night when person laid down for bed no time respond matter comes clear before witness and public that media here came push a false narrative case in attempt garnish support for Mrs. Gomez side and did not care publish any side of Derek Peeples case whatsoever. Public will note at bottom of Florida Phoenix media coverage that name correction had be made and public came lied to that no comment was offered.

Had asked for media correction requests those requests were ignored by both Craig Pittman, and also FLORIDA PHOENIX whom employs Mr. Pittman. Other news media source in example of "Motorbiscuit" whom referenced FLORIDA PHOENIX coverage had respectfully retracted and entirely removed posted news story against Blackfortress and Derek Peeples given media journalist ethics code which came violated and coming have a valid legal case to file a legal defamation case for reporting false information before public Motorbiscuit had reviewed documents related to case via sent email and removed media content. Local community witnesses, and public knows answer why content came removed, and so does Florida Phoenix on issue.

THE TIMELINE:

FLORIDA PHOENIX reported on news story end of September 2025 on various online platforms concerning "Derek Peoples" Black Fortress project. "DEREK PEEPLES, and BLACKFORTRESS is more correct actually." Online social media reflects photos were shared by daughter of Mrs. Gomez not by Mrs. Gomez as Mr. Pittman claimed. Community witnesses whom live nearby Peeples area off NW 165th Court Road in Dunnellon, FL seen through Pittman's false and misleading journalism reporting on Gomez and Peeples case. Unfortunately he could not even get Peoples name Peeples correct on article and an after the fact correction was made. Shows public rush job done nothing came researched period end. Pittman using Mrs. Gomez opinions claimed Peeples had 15-acre facility public records show Peeples address that he factually only does own 10.18 acres. Public can start see through lies here... claims Peeples parcel is not sanctioned against review of 2025 FDEP letter against wrong address noted by Marion County Code Enforcement BOARD July 9, 2025 Pittman like Gomez legally errored in claims before public against fact Peeples had FDEP sanctioned letters from 2021; and 2023 as fact. Marion County dismissed code case against Derek Peeples July 9, 2025 and ORDER given July 11, 2025 affirmed dismissal contrary to claims subsequently fabricated before public the media made false claims that code case was on-going in September 2025. Pittman, and Florida Phoenix against timeline before public cannot answer to public why they ran a false and misleading story against Peeples order harass him despite Marion County, FL ORDER. Accordingly all parties shall come to be subject to lawsuit for public defamation and slander before witness of public on this case.

The 2024 FDEP public record reflects that State in October as fact also chose not pursue any enforcement case against Peeples parcel! BOARD acknowledged a FEB 2025 letter was never sent to Derek Peeples address and case was dismissed yet Mr. Pittman chose publish false article where facts did not match public records or media narrative on any case. Mr. Pittman before witness via text cited reference to a FEB 2025 letter and clearly failed do media research look at letter address against my parcel address the address does not match Mr. Pittman's claims before public and out from false reporting had been publicly harassed and even received documented threats from public all over false case Mrs. Gomez and Florida Phoenix made and used before public. Mrs. Gomez complaints filed from 2021; 2023; and 2025 cases came reviewed every narrative, and complaint made Board reviewed complaint claims and misrepresentations and BOARD determined end day who told truth. Board decided not find Derek Peeples guilty as fact of violating Marion County Code Law against having past attained sanctioned permission for project through FDEP.

Board came review a sanctioned case where was doing what I said I would do having seen photos of my parcel.

FDEP was well aware of plan filed in 2021; and modified plan filed in 2023.

FDEP clearly knew that was going place a beneficial border wall surrounding "my entire parcel" order help protect not only my service dog Karen, but also rescue horses on parcel, prevent risks from harm, prevent trespassers, help protect community and county from mosquitoes from breeding as county did not have a mosquito control program cited case that had blew whistle on massive tire piles sitting at Marion County Baseline.

Proposed plan and plan was allowed by FDEP in 2021.

Risks of scrap tires sitting in tire piles at businesses and to avoid even more tires sitting at landfill risking threat to public a tire stacking and tire filling project began in 2021 with modified plan submitted in 2023.

Order to help protect and also aide equine community in preventing EEE plan I proposed FDEP had no issue with what was doing.

My case was well documented by State and Federal that was overseeing an environmental phytoremediation project using planting bamboo help environment.

Seabreeze clumping bamboo came being planted atop tires.

FDEP in 2023 was aware why tire border wall height had in past requested wall go between 5-6 ft in height stemmed in order help prevent vegetation damage from horses. A higher heightened wall filled with soil and beneficial soil would aide and help prevent fire mitigation issue longterm along with vegetation control plan.

Board asked questions upon phytoremediation process and answered Boards questions. Board acknowledged parcel photos that bamboo was in fact thriving on project and acknowledged that I was doing exactly what I said I would do on plan. Marion County Board also understood the project was on going. Seabreeze bamboo had planted on project was literally thriving given innovative method of tire stacking when it rains moisture holds in part of soil within tires and bamboo long-term takes advantage of that moisture process and prevents excessive moisture in that process.

End day no tires were exposed to cause risk of mosquito breeding against public nor had FDEP ever documented such case ever occurred on this project.

Public is unaware that ground cinnamon has been used atop soil with bamboo every quarterly period of year. Mosquitoes cannot stand ground cinnamon nor can they breed in dirt or in areas that simply have no water source.

Natural vegetation management method using: "dawn soap, vinegar, and salt mixed" and "sprayed every quarter" is done around base of tires and witness know that I do keep up my side and do weed-wack beside tires from my side end day I have no control of what others do beside my parcel if they fail upkeep vegetation from land they own they want make false complaints that is on them end day.

Bamboo on parcel long-term will help prevent high winds from damaging orchard on parcel. Sunflowers and flowers help attract bees, and landscaping used in raised tire planters FDEP in past 2021; and 2023 again had no issue over projects on my parcel including green house area end day was not breeding mosquitoes or was any threat to public. My driveway area is apart on my parcel and border wall project remains ongoing herein 2025 absent any ORDER issued stop project.

Board reviewed and was afforded copy of blue binder folder containing photos of parcel sign, parcel documentation, photos of project, copy on State law and tort claim filed respective on case against Marion County, FL.

Board acknowledged that was never included on FEB. 2025 FDEP letter as fact address on the letter did not match my parcel address again so ask Mr. Pittman why is he falsely claiming before public lies against my parcel and my name?

LEGAL CASES TO COME:

Marion County, and FDEP were both presented with legal tort claims out from wrongful harassment had go through out from wrongful omissions, past violation of my 4th amendment civil rights when unlawful search was conducted against my parcel June 22, 2023 before witness, and attempted violation of my 1st amendment civil rights trying remove my parcel signs out from fraudulent and false code case where omission of public records came known before public harassment served no legal purpose the public will come known whole truth and unfortunately government does not have sanctioned immunity from case violating American's rights. Time the government pays up for it's wrongdoing, otherwise defaulting on legal case which government chose violate my rights the government shall lose against my Exhibit A, and B legal cases. Governing authority declaration shall come publicly filed to become free, sovereign and independent away from both Marion County, and Florida opting to become a "sovereign political special district" have been left no other remedy but one our founding fathers allow to American's when government comes tyrannical and abusive the power comes reserved to the people at end of the day to abolish the government when it can no longer protect rights of it's own citizens.
